5. Giving of 20 feet to State for future road widening. <br /> They must determination if it will be easement or conveyance <br /> of property. <br /> C. Site clearing plan-- the applicant thinks it is more <br /> appropriate to make the Special Permit subject to approval <br /> of a site clearing plan approved by Design Review Committee <br /> and then will come back to Planning Board to set up a <br /> definitive clearing plan. <br /> Tony suggested the condition can read "no clearing shall } <br /> take place until the Planning Board has approved a plan" . <br /> 7. Contribution to roadway improvements (pg. 16 condition <br /> 26) . Mr. Dittami stated that they are contributing 1% of <br /> the traffic and they don't know what the improvements will <br /> be or how much they will cost. They are already providing <br /> for a situation which will help mitigate traffic on that <br /> roadway. If there was §omething definitive laid out to <br /> agree to they would consider it but do not agree to it in <br /> this condition. � <br /> Board would like an added condition that no occupancy <br /> - p Y permit <br /> shall be issued if there is any violation of this Special <br /> Permit, <br /> Mr. Dittami stated that he would -like that to add if it is <br /> being appealed, and they feel they have a valid appeal the <br /> permits can be issued, as long as it does not involve , <br /> structural integrity of the building_ <br /> The Board explained that they need a mechanism to keep the ` <br /> applicant honest. <br /> , <br /> Mr, Dittami stated that they would like to give the <br /> developer a way to rectify the problem without having permit <br /> denied, thus giving the developer a chance to plead his <br /> case. <br /> Board discussion of conditions: <br /> 1 .
