i <br /> Lee Gurney inquired whether or not there are other <br /> homeowners in this Subdivision who have a similar- easement <br /> on their property. <br /> The Town Planner responded that everyone along the <br /> perimeter would have the same easement . <br /> Lee Gurney expressed concern for setting a precedent . <br /> The Town Planner asked if the proposed addition could <br /> be located in the deck area. He made reference to the <br /> topogtAphy of the area noting one corner of the house i <br /> located on fill due to the grade. <br /> Mr. Westman replied he would have no access . <br /> There was some discussion suggestions regarding the <br /> possible relocation of the proposal, setback requirements, <br /> and concerns regarding infringement into the buffer area . <br /> r. Westman requested approval o-f an additional 20-ft . <br /> into the easement/buffer area . <br /> The Town Planner reiterated this decision would have <br /> to be made through the Public Hearing process, with proper <br /> notice to the abutters. Mr. Westman would be required to <br /> mare a proposal on a plan for Planning Board <br /> discussion/approval at that time. <br /> The discussion this evening is for Planning Board <br /> consideration of the proposal. <br /> Dennis Bal arini stated he would consider a 3-4 ft . <br /> proposal around the building. <br /> Mr. Fowler cautioned against vegetation being so dose <br /> that it would be up against the building, and that it right <br /> make more sense to use the green lime indicated on the <br /> proposed drawing as the extent of the easement . <br /> The Town Planner commented on possible legal <br /> issues/violation in the event an actual easement document <br /> has been recorded in someone' s favor. <br /> Lee Gurney stated her concerns for setting what she <br /> called an "unfortunate precedent" and that open space <br /> 7 <br />
