Public Hearing <br />C . Ta lanian Realty Company -Donna' s Lane Route 2 <br />South ape Village Special Permit Modification <br />The Chairman called this matter to order and <br />recogni zed Don Iegathl in . <br />Mr. Megathlin stated that at the time of the Special <br />Permit approval in 201, the Planning Board approved a <br />waiver for setbacks on private streets. He Mated that all <br />but two of the buildings exceed ten feet. Building C i <br />1.7 feet and Building A is 5.8 feet. <br />References were being made to a neap entitled, ..Ma.shpee <br />Investors, LLC, C.. Talanian Realty Co., Inc., South Cape <br />Village, Mashpee, MA, Special Permit Modification Plan for <br />Building setbacks, by Ba te'r & Nye Engineering and <br />SurveyIng, dated 09 09 0 ". <br />The Town Planner noted that there is one setback not <br />shown on the plan, the canopy located at the entrance to <br />Roche Bros. <br />The Board requested Applicant to revise the plan to <br />show the canopy, as well as the thirty-foot layout. <br />The Town Planner also suggested a. new Condition be <br />included within the Modification specifying that the <br />setbacks as shown on the revised plan are to 'e approved by <br />the Planning Board. <br />The Town Planner made reference to the Eastetn Bank <br />property; stating plans are to be submitted shoring a <br />realignment of the driveways. Zoning Board of Appeals <br />final approval of the Revised Site Plan will be required. <br />Mr. Rowley reported that a consultant from Eastern <br />Bank -has informed him that they intend to present a plan t <br />the Design Review Committee for approval. At that point <br />a nothe'r formal application will be filed with the Board of <br />Appeals. <br />Applicant has suggested a performance guarantee in the <br />amount of $45,000.00, to rebuild the sidewalks across the <br />two entrances. <br />110 <br />
