There being no further Board, Staff', or Public comment the Chairman entertained <br /> a motion. <br /> -MOTION: Dennis l al arini made.a Motion to continue the Public Hearing in <br /> this matter to February 18, 2009 at 7:45 p.m.; which Motion was duly seconded by Jarnes <br /> Leonard and so voted unanimously-, <br /> Preliminary Subdivision Plan <br /> willowbend Country Club, Inc. - Submission of -Lot Preliminary Subdivision Plan <br /> The Chairman recognized Attorney Jack McBlhinney, representing the Applicant. <br /> He presented a procedural submittal of a preliminary subdivision plan for willowbend <br /> Circle consisting of a -lot subdivision that will access onto Quinaquisset Avenue. There <br /> are currently several trailers on the property that have been scheduled to be demolished. <br /> There is also an existing duplex structure on the property which will be relocated within <br /> lihee to be used as affordable housing. <br /> The Town Planner determined the filing to be complete, requesting-the Chairman <br /> sign Form N for filing with the Town Clerk. <br /> (At this point the Chairman declared a five minute recess. The February 4, 2009 <br /> Planning Board fleeting was reconvened at 8:05 p.m. <br /> Special Permit <br /> 1iashpee Investors LLC-South Cape village Shopping Center <br /> Site Plan Modification to Convert Joy Street Pedestrian Walkway <br /> to Street and Parking Area <br /> The Planning Board voted 3-2 on November 5, 2008 that no Public Hearing is <br /> required. This matter has been continued from December 17, 2008. The Cape Cod <br /> Corti fission Staff has indicated that they have jurisdiction as DRI change. <br /> The Chairman stepped down from hearing this matter and left the Conference <br /> Room in order to avoid any possible conflict of interest. Before doing so he appointed <br /> the vice-Chairman, Bennis Balarini to preside over this matter. <br /> 'The vice-Chairman recognized Hon 1 iegathlin, representing the Applicant, who <br /> informed the Board that the Cape Cod Commission has been made aware that Applicant <br /> is appearing before the Board'this evening. The Commission has no objection.to this <br /> meeting, however should the vote tonight be in the alb rn tiv , that there be a proviso <br /> indicating `subject to approval by the Cape Cod Commission". Applicant is scheduled to <br /> appear before the Cape Cod Commission Regulatory Committee on February 17, 2009. <br /> 7 <br />
