• <br />0 <br />MASHPEE ZONING BOARD OF APPEALS <br />APRIL 24, 2013 <br />MINUTES <br />Mr. Blaisdell mentioned at the request of Paul Dardano, in an email sent to Mary <br />Ann Romero dated Monday, April 22, 2013 at 8:27 p.m., Subject: 12 Pine <br />Avenue. "Ms. Mary Ann Romero, we are unable to attend the hearing scheduled <br />for April 24, 2013 regarding the tear down and rebuild of the Dorie Krawiec and <br />William Cusick home at 12 Pine Ave. We own 23 Pine Ave. We have had the <br />opportunity to review the plans for the new home. We are pleased to see the <br />footprint is under 20% coverage. We believe that their proposal is reasonable, and <br />will be an attractive addition to our neighborhood. We wish to offer our full <br />support for their plan. Please have our comments read for the record. I can be <br />reached at the certain phone number, if you have any questions. Thank you, Paul <br />Dardano and Beth Shepherd." <br />Ron Bonvie made a motion that we issue a Written Finding under §174-17 of the <br />Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension <br />or alteration of pre-existing, non -conforming structures to allow for construction <br />of a new dwelling on property located in an R-3 Zoning District at 12 Pine <br />Avenue, (Map 123 Parcel 38), Mashpee, MA. In reference to this motion that the <br />Board finds that the proposal is not substantially more detrimental than the <br />existing non -conforming structure, that the new dwelling will be an improvement <br />and will conform to current building code requirements, is comparable in size and <br />character to other structures in the neighborhood and that there is sufficient <br />parking and setbacks as may be required. Also, make note and reference to a <br />Board of Health statement that the lot is in Zone II and is restricted to a three <br />bedroom dwelling and reference the following plan, prepared by BSS Design and <br />Engineering and Survey, dated March 20, 2013 prepared for Doric Ann Krawiec <br />and William Cusick of 12 Pine Avenue and job number 12086 prepared by EJP, <br />TJB, scale 1" = 20'. This is also conditioned upon installing roof draining dry <br />wells. <br />Mr. Bonvie made a motion to issue a Special Permit under § 174-20 of the Zoning <br />By-laws concerning rebuilding of destroyed or damaged non -conforming <br />structures to allow for rebuilding of a single-family dwelling on property located <br />in an R-3 Zoning District at 12 Pine Avenue (Map 123 Parcel 38) Mashpee, MA. <br />The said Special Permit is in reference to the side yard setback which would be 5 <br />foot distance from 15 to 10 feet on both sides as depicted in the attached plot plan <br />and referenced in the prior motion. I would also like to make reference to the <br />same Board of Health statement that the lot is in a Zone II and is restricted to a <br />three bedroom dwelling and reference the attached plan, prepared by BSS Design <br />and Engineering and Survey, dated March 20, 2013. <br />Mr. Blaisdell seconded the motion, Votes: Mr. Furbush, yes, Mr. Reiffarth, yes, <br />Ms. Horton, yes, Mr. Dorsey, yes, Mr. DeBarros, yes. All were in favor. <br />
