MASHPEE ZONING BOARD OF APPEALS
APRIL 24, 2013
• MINUTES
Susan Howard, a direct abutter at 33 Seconsett Point Road addressed the Board.
She had a copy of the plot plan and is requesting that if the Ferris' are granted the
right to tear down the subject garage and build a new non -confirming garage they
respect their property boundaries. She stated she did not object when a one story
house changed into a two story house. Her concern is the area on the plan that
depicts the driveway, and a landscaped island which appears to be beyond their
property line. She stated Seconsett Point Road is a dirt road for residents only and
does not have sidewalks. It's a right -of way in the middle of Seconsett Point, and
everyone that lives there has a right to pass over their property.
She is asking that the development on the lot stay within its clearly delineated
boundary lines. She does not want to see cobbles or bushes in the street that is
beyond their property line. She is asking as a condition approving this request,
whatever development, they keep everything within their property.
John Slavinsky stated there will be no construction in the road and the
"horseshoe" shaped driveway will measure 14 feet wide at each end.
Bill Blaisdell read the email from Andrew McManus, of the Conservation
Commission dated Friday, April 19, 2013, 9:46 a.m. addressed to Mary Ann
• Romero, in regard to 36 Seconsett Point Road. "Conservation Commission did
approve there amended order request to move the garage to the proposed location
at their April 11 `h meeting. An abutter to the property had some issues regarding
setbacks from Seconsett Point Road, particularly the driveway layout; however,
this was not in the Conservation Commission's purview as our setbacks pertain to
wetland resource areas. The Conservation Commission suggested that the abutter
address her concerns to the Zoning Board of Appeals."
Ron Bonvie made a motion to approve the Written Finding to David M. & Ana S.
Ferris of Finding under §174-31 of the Zoning By- laws for demolition of an
existing garage and allow construction of a new garage on property located in an
R-3 Zoning District at 36 Seconsett Point Road, (Map 124 Parcel 38), Mashpee,
MA.
2
