0 <br />MASHPEE ZONING BOARD OF APPEALS <br />MAY 22, 2013 <br />MINUTES <br />John Slavinsky stated he filed this petition as a special permit for a dock that's greater than 70 <br />feet in length. But did not file under 174-25H (7), which states you are allowed to build a <br />dock, garage, or greenhouse, etc. because the dock is considered an accessory structure. This <br />particular lot is unbuildable because it would not pass the Board of Health perk test, which <br />they allowed on the abutting house 12 to 15 years ago. <br />Mr. Blaisdell stated there were problems in the past with building a dock without a home <br />already on the lot. John Slavinsky agreed with this statement as this lot will not pass the <br />Mashpee Board of Health. <br />John Slavinsky would like to re -file under 174-25-E (5) as a marina, which states under <br />definition for the storage or mooring of boats with frontage and navigable body of water. <br />Mr. Blaisdell made a motion to continue to June 12, 2013, Jeanne S. Mantel and Lewis <br />Mantel Trustees request for special permit under 174-25.I.9 of the zoning by-laws to allow for <br />construction of a landing, stairs, pier, ramp and float extending across a total of more than <br />seventy feet of coastal beach, coastal bank, salt marsh, or bordering vegetated wetlands and/or <br />coastal wetlands, freshwater wetlands, swamps or marshes on property located in an R-3 <br />zoning district at 270 Monomoscoy Road (Map 120, Parcel 58), Mashpee, MA. <br />• John Dorsey seconded the motion to continue, Votes: Mr. Furbush, yes, Mr. Blaisdell yes, Ms. <br />Horton, yes, Mr. DeBarros yes, all in favor. <br />• <br />Cotuit Solar: Request a Variance under §174-31 (Land Space Requirements) of the Zoning <br />By-laws and M.G. L. Chapter 40A § 10 for relief from the front, rear and side setback <br />requirements of a residential structure located in a C2 Zone at 36 Savannas Path, Mashpee, <br />MA. <br />Cotuit Solar: Request a Special Permit under §174-24, §174-25 D (1) and §174-41F for <br />redevelopment of a residential structure for office use along with the construction of a solar <br />warehouse facility to store supplies, and meet the adequate parking requirements for the <br />business located in a C2 Zone at 36 Savannas Path, Mashpee, MA. <br />Attorney, Michael Koretz, introduced himself representing Cotuit Solar, and Conrad Geyser, <br />Principal of Cotuit Solar, Joseph Hackler, and Michael Aucoin, Engineer. Mr. Koretz stated <br />that 36 Savannas Path was formerly in an R-5 residential zone, and was changed to a C-2 zone <br />at Town Meeting, in May 2010. The current dwelling was used as a residence and was <br />foreclosed on when Mr. Geyser bought the property in February, 2012. He stated Mr. Geyser <br />is proposing to develop the parcel and manage his solar energy business at the existing <br />dwelling. Mr. Geyser is also looking to construct a pole barn for storage of his equipment and <br />products. <br />2 <br />
