At this point Attorney Taipale requested clarification <br /> from the Board as to the exact information required in <br /> preparation for the next meeting. <br /> Topography, drainage, language., final inspection of <br /> Phase II, and Board sign-off. <br /> Attorney 'Taipale Revisions to Conditions in the <br /> original 1997 Permit: <br /> Condition #'10 makes reference to the fact that - <br /> built plans must be presented at the completion of each <br /> .phase. Applicant is requesting that in the event all <br /> roadways:, landscaping, and revegetation of eonunon <br /> facilities for Phase II prior to Board approval of plans <br /> for Phase III, that building permits would be approved for <br /> Buildings 41 through 50 of Phase III ,in order to allow <br /> Applicant to move forward with the project. The <br /> anticipated date of completion of Phase II being July of <br /> 2003. <br /> The original permit provides that the last fifteen <br /> (15) units in Phase III would not be issued until all <br /> roadways, landscaping, and revegetation of common <br /> facilities are completed. Applicant is requesting <br /> language, which would provide for a bond in th'e event such <br /> work, cannot be completed due to weather conditions, timing <br /> issues, etc. <br /> The Town Tanner interjected that there is no security <br /> being proposed for Buildings 41 through 50 . Basically ghat <br /> Applicant is proposing is that if Phase II is not <br /> completed, construction of ten (10) buildings in Phase III <br /> would be approved without any security for landscaping. <br /> Be noted there would be no way of knowing whether the <br /> amount specified, $5, 000. 00 per unit, would be adequate to <br /> cover the amount of landscaping that would required. An <br /> actual bid or cost estimate from the contractor to be <br /> reviewed by the Board/Consulting Engineer would be in order <br /> to establish an appropriate amount for security would be <br /> preferable . <br /> He also suggested a cash deposit of some sort, rather <br /> than an insurance bond be considered when posting a bond. <br /> 7 ` <br />
