There being no further discussion, the Chairman <br /> entertained a motion. <br /> MOTION : Don Myers made a Motion to proceed as drafted <br /> on "Proposal to Release Dots 23 & 3.0, dated October 15, <br /> 2 03" pending adequate completion of pavement and any other <br /> requirements imposed by the Consulting Engineer as outlined <br /> for paving the unpaved portions in front of Lots 23 and 3 ; <br /> and those portions of Candlewood Lane and Fox Mill Road as <br /> well . said Motion was duly seconded by Dennis Balarini <br /> and so voted unanimously. <br /> Public Hearing <br /> Zoning Article' s for October Town Meeting <br /> Section 174-4 . 4 . Accessary Apartment Bylaw - The <br /> Ass-istant Town Planner reported specification has been made <br /> that Special Permits authorizing one accessory apartment <br /> per lot will be granted by the Zoning Board of, Appeals . <br /> The word "dwelling" has been deleted; the word <br /> %%apartment" is used for consistency. <br /> The following l-anguage h,a,s- been added-t,o the text, <br /> - - - <br /> "The proposal shall require review and recommendations b <br /> the Design Review Committee" as- well as, "Appropriate <br /> landscaping may be required in order to provide a buffer <br /> between the Applicant' s lot and abutting properties" , <br /> " 10 new driveway or curb cut shall be created to <br /> service t-he accessory apartment" has been added. <br /> "The special Permit shall be condi-tioned on a review <br /> by the Board of Appeals at a noticed public hearing every <br /> three (3) years to determine conformance with all <br /> conditions and impact on neighboring properties . Prior to <br /> the public hearing the Building Inspector shall conduct a <br /> Site Inspection to determine whether all Conditions of the <br /> initial approval are being met" has been added. <br /> The Affordable Dousing Conunittee has voted -o to <br /> remove the above Clause " " . They voiced concern regarding <br /> protection of the property owner' s investment, stating <br /> there are existing remedies within Town regulation to <br /> address zoning violations.
