The Chairman .made reference to- prior concerns raised <br /> by the Board regarding how to best protect residences <br /> within residential areas and possible adverse impacts upon <br /> property values . <br /> The Chairman raised concern regarding difficulties, <br /> due to limited staffing within the Building Inspector' s <br /> Office, to enforce Bylaw Regulations in the event of a <br /> violation. <br /> Dennis Balarin-i stated he feels the addition of <br /> clause "J" proves to defeat the purpose of the Article. H <br /> expressed concern for the situation in which a property <br /> owner has ingested a sum to money to provide an accessory <br /> apartment to find that a neighbor could file a complaint <br /> and prevent the rental opportunity. <br /> Lee Gurney suggested a clarification of language i <br /> clause "I" concerning revocation of the Occupancy Permit in <br /> the event any of the required Conditions are not met. <br /> The- Town Planner was uncertain as to whether the <br /> Certificate of Occupancy could be used as a zoning <br /> r forcement -me ch nism- -as it- �fa-ll- .. .under the -Bu-ilding - Cod-e�. - <br /> s-tee Dolan expressed concern, regarding the proposed <br /> throe year review as it would affect signed/pending leases, <br /> and therefor complicate the issue of affordable housing . <br /> Dore Dyers raised concerns regarding absentee owners; <br /> suggested a follow-up mechanism to insure the premises is, <br /> in fact, the owner' s primary residence. <br /> The Town Planner suggested language be amended t <br /> state that evidence must be provided even three years that <br /> the owner is occupying the -primary unit. <br /> Subsection "A" _ Don Myers suggested, "on an annual <br /> basis, coinciding with the initial date of the issuance of <br /> the Special Permit, the owner of the property shall submit <br /> to the Building Inspector Buff icient evidence to <br /> demonstrate occupancy of the principal dwelling unit" . <br /> The Chairman clarified proposed subsection "'J" is t <br /> be deleted. <br /> 4 <br />
