MASHPEE ZONING BOARD OF APPEALS <br />• SEPTEMBER 11, 2013 <br />MINUTES <br />The proposed building on this lot is smaller than the current building in terms of its <br />footprint. The existing lot coverage figure is 701 square feet or 23.6%. Taking into <br />consideration of the additional 68 square feet that is situated in the street, the total square <br />footage in terms of its footprint building coverage is 25.9%. The lot coverage of the new <br />structure once moved entirely within the lot, and including the one foot overhang on the <br />second floor will be 715 square feet or 24.1% which is less than the 25.9% building <br />coverage but a little greater than the existing 23.6% lot coverage. <br />Jim Reiffarth read the comments submitted by the Conservation Department. "The <br />homeowners will need to file a Notice of Intent with the Conservation Commission for the <br />demolition/rebuild of the existing home. A portion of the property lies within 100 feet of <br />the top of coastal bank and the property is also within the 100 year floodplain". <br />Ron Bonvie made a motion to issue a Written Finding under Article V § 174-17 and § 174- <br />20 to Robert and Marjorie Hackett to raze and replace a dwelling on 10 Stanley Road. The <br />motion is contingent upon the applicant obtaining an order of conditions from the <br />Conservation Commission and approval from the Board of Health and the following plan <br />needs to be signed by a registered land surveyor and engineer for the proposed site plan at <br />10 Stanley Road, Mashpee, MA, and the same land surveyor sign and include the elevation <br />plans with the same data on the proposed site plan confirming the height. <br />• Also contingent upon the proposed site plan for Robert Hackett prepared by JC <br />Engineering, Inc. 2854 Cranberry Highway, East Wareham, MA 02538, scale: V = 20', <br />dated August 13, 2013, Rev. 1: dated 9-11-13 (House size and egresses). Note: This plan <br />needs to be signed. Also, attached are the architectural plans for client: Bob Hackett, job <br />location: 10 Stanley Road, Mashpee, MA 02649, designed by CBC Design Group Clark <br />Baker Clarke consisting of CS -100 to DW -100, and also needs to be signed by a certified <br />land surveyor and/or engineer, and include the elevations on the site plan and demonstrate <br />the building height is less than 35 feet or less. Issuing said finding, the Board finds the <br />dwelling not substantially more detrimental than the existing non -conforming structure and <br />the new dwelling will be an improvement and conform to current building code <br />requirements. It is comparable in size and character to other structures in the neighborhood, <br />and has sufficient parking and setbacks as may be required. <br />• <br />Richard Jodka second, yes, Votes: Jim Reiffarth, yes, Dom DeBarros yes, Bill Blaisdell, <br />yes. All were in favor. <br />Mashpee Commons Limited Partnership: Request minor revisions under Special Permit <br />SP -86-04-024 to address actual built conditions, relocate certain square footage of building <br />space and location of parking areas, and previously approved residential units as permitted <br />on property located in a C-1 Zoning District, at 38 Nathan Ellis Highway, Unit 31, (Map <br />74 Parcel 20), Mashpee, MA. <br />7 <br />
