Present were Board Members, Jonathan D. Furbush, William A.
Blaisdell, Ronald Bonvie, James Reiffarth, Richard Jodka and Associate Member,
Domingo K. DeBarros. Also present was Building Commissioner, Richard E. Morgan.
Jonathan Furbush opened the meeting at 6:00 pm and announced the meeting was not
televised.
CONTINUED HEARING
Arthur R. and Darlene E. Joia: Request a Variance under Article VII §174-31 (Land
Space Requirements) of the Zoning By-laws to vary the front and side setback requirements
to locate a shed in an R-5 Zoning District at 49 Somerset Road, (Map 16 Parcel 11),
• Mashpee, MA. (Continued from October 9, 2013 hearings).
Mr. Joia presented an updated site plan as the Board requested which depicts the property
and area that he proposed to place the shed. The plan was not stamped and will be
contingent upon Board approval. Mr. Joia stated he has a hardship with the rear of the
property due to the location of the septic system. He stated the updated septic will require
11' x 32' along with a reserve area of 11' x 32' with no room available for the shed and
would require a Variance for this project. He stated he is requesting to place the shed in the
left side front section. He moved the shed closer to the garage approximately 5.2 feet and
is seeking relief for this area.
Mr. Furbush asked if there would be a foundation. Mr. Joia stated there will be no
foundation, it's an existing shed that he moved from another location that has an 8 X 8
railroad tie skirt around it and sits on the ground and is not bolted down.
Mr. Morgan stated he made a site visit and suggested to place the shed as close to the
garage as he possibly could and put a gate or a fence around the area to make it esthetically
uniform between the house and garage.
Mr. Bonvie made a motion to issue a Variance under Article VII § 174-31 (Land Space
Requirements) of the Zoning By-laws to vary the front and side setback requirements to
locate a shed in an R-5 Zoning District at 49 Somerset Road, (Map 16 Parcel 11),
• Mashpee, MA. The Variance is for a 20 foot front setback and an 11.7 foot side yard
setback.
