Chapter 40A §6 concerning continuance, extension or <br />alteration of a pre-existing, non -conforming structure to raze and replace a dwelling on <br />property located in an R3 Zoning District at 17 Overlook Knoll Road, (Map 118 Parcel <br />36), Mashpee, MA <br />Micliael and Lori Laskin Bloom: Request a Written Finding under Article V § 174-20 of <br />the Zoning By-laws and M.G.L. Chapter 40A §6 By-laws concerning rebuilding of <br />destroyed or damaged non -conforming structures to allow for rebuilding of a single-family <br />dwelling on property located in an R3 Zoning District at 17 Overlook Knoll Road (Map <br />118 Parcel 36), Mashpee, MA <br />Michael and Lori Laskin Bloom: Request a Variance under Article VII §174-31 (Land <br />Space Requirements) of the Zoning By-laws to vary the rear, front and side setback <br />requirements to raze and replace a new single-family dwelling on property located in an R- <br />3 Zoning District at 17 Overlook Knoll Road (Map 118 Parcel 36), Mashpee, MA <br />The Petitioner, Lori Bloom, represented herself and provided a plot plan prepared by Cape <br />& Islands Engineering, and a set of house plans prepared by Michael Jimerson, Architect <br />that depict the required dimensions and setbacks. She consulted with Cape and Islands <br />Engineering and thought the required setbacks were 15' front and 15' rear. Lori later <br />discovered the correct setbacks were 25' front and 15' rear. She stated she does not require <br />a side Variance. <br />Mr. Furbush stated he made a site visit and discovered a few items on the plans that need <br />clarification by the Architect and Engineer. He stated the house plans depict a possible 3 - <br />story home showing windows and doors on the lower level above the ground. He stated the <br />allowed amount of stories on a dwelling in Popponesset is 2.5 stories. <br />Mr. Furbush stated he has an issue with the proposed setback from Seaview Avenue. He <br />stated the setback on the plan for the deck is 22.6 and should be 25, but the new plan shows <br />18.2 and should be 25. He also stated that cantilevers are included as lot coverage. <br />
