MASHPEE ZONING BOARD OF APPEALS
Decision for Minor Modification
Comprehensive Permit CP-2010-29
10. At the time of the submission of the Application, the Applicant had proposed a
private on-site septic system but was actively seeking the Town of Mashpee's
permission to connect to the wastewater system at the Town's nearby High
School. As of the September 8, 2010 hearing session, it appeared that the Town
was prepared to grant permission for such connection.
11. As shown on the Plans, the new buildings in the Project are proposed to be served
by a single access driveway. The buildings are to be generally oriented around a
common parking area.
III. FINDINGS
1. The Board finds that the Town has a continuing need for affordable housing and
that this Project will provide such housing. The Board finds that the Project is
consistent with the Town's Affordable Housing Plan.
2. The Board finds that HAC has considerable expertise and a vested interest in
developing and managing affordable housing.
3. The Board finds that the Project will be better served by a connection to the
municipal wastewater treatment system at the High School, rather than the
initially proposed on-site system.
4. The Board finds that, as shown on the Plans, the Project exhibits generally
satisfactory access for fire-fighting purposes. The Board finds however, that
additional assurances must be provided to the Fire Department.
5. The Board finds that the amount of parking at the project may be insufficient and
that the conditions of approval must include provisions for construction of the
"shadow parking" shown on the Plans.
6. The Board finds that based upon review by its engineer Charles Rowley, the
Project will likely provide adequate management of stormwater but requires
further review by the Board's engineer.
7. Notwithstanding the above-described impacts to local concerns, the Board finds
that the Project, as conditioned by this Decision, will be "consistent with local
needs," as such term is contemplated under c. 40B.
8. The Board finds that the grant of waivers from local by-laws and regulations, as
described more fully in Section IV hereof, is acceptable although the grant of any
waivers may cause adverse impacts to local concerns. Nevertheless, the Board
finds that the local concerns that have been affected thereby do not outweigh the
statutory requirements for affordable housing, especially given the mitigation that
has been provided by the Applicant.
3
