Consulting Engineer Charles Rowley questioned the undefined length of'the drainage easement. Ms. <br />Laurent discussed the issue with Town Counsel who has indicated that the language of the Article <br />gives the right to maintain the drainage and that the plans can not be amended at this time. <br />MOTION: fir. Ba arini made a notion to recommend taking over Bayshore Drive and <br />Brookside Circle. Mr. Mullin seconded the motion. Ail voted unanimously. <br />SPECIAL PIERMffS <br />Atty. Dan Creedon-Informal Discussion of Proposed Development at 64 Industrial Drive <br />Mr. Creedon called in advance to cancel his attendance at tonight's meeting. <br />Applicant: Mark Lima Ashers Heights Homeowners <br />Location: Ashers Heights Subdivision <br />Request: Modification. of special permit to eliminate water qualm monitoring program — need to <br />schedule public hearing <br />In addition to requesting a modification to the special permit, the applicant wishes also to request a <br />reduction to the application fee. Mark Lima, resident of Ashers Heights subdivision, reported. that an <br />application was filed on September 29 to relinquish the subdivision from monitoring the wells, <br />eliminate the 1000 foot requLremem and to reduce rewired lees associated wig filing the application <br />so as not to exceed $135. fir_ Fudala noted that the typical application fees include a oo application <br />fee, o- fee for advertising and oo minimum review fee_ fir. Fudala added that an engineering <br />review is not needed. Mr. Fudala. suggested that adminisuative work would be necessary and <br />recommended the $135 free to Mr. Lim& A letter has been received requesting the application fee <br />reduction and was read for the record - <br />MOTION: Mr. Bal arini made a motion to reduce the application fee to S135 and waive the <br />review fee. Mr.-Kooharian seconded the motion. All voted unanimously. <br />MOTION: Mr. Bal arini made a notion to- schedule a public hearing for Ashers Heights - <br />Homeowners Association on November 3rd at 7:10. Mr. Kooharian seconded the motion. All <br />voted unanimously. <br />Richard Heinberg, of 7 Butler Lane, asked to be recognized and questioned the next step in the <br />process. Mr. Fula responded that the Board would make a decision after the public hearing is closed <br />and the written decision will be filed at the Registry ofDes before it is effective. Chairman W a +g n <br />clarified that at the public meeting, the hearing will be opened and the petitioner will present the <br />application. The Board gill question the petitioner and the public will be allowed to convent. Once <br />the hearing is closed, the Board will discuss the application and make a decision on the matter. Mr. <br />Fud la noted that after filing the decision with Town Clerk, there is a 20 day appeal period, but <br />ollov ing the appeal period, the decision will be signed by Planning Board members and filed at the <br />Registry of Deeds. Mr. Lima questioned the completeness of the application and Mr. Fudala <br />recommended that a letter be submitted to more completely explain the reasons for requesting the <br />waiver. The Chair added that detailed explanations are necessary to clearly indicate why the request is <br />in the best interest of the public.
