r <br /> MOTION: Dennis Bal arini made a Motion to close the <br /> Public Hearing in this matter; which Motion was duly <br /> seconded. by Lae Gurney and so voted unanimously. <br /> MOTION: Dennis B l arini made a Motion to approve the <br /> road design layout as presented to the Board this date on <br /> plan dated November 7, 200 ; which Motion was duly seconded <br /> y Lee Gurney and so voted unanimously. <br /> MOTION: Dennis Bal arini made a further Motion to <br /> approve the Subdivision Plan dated February 3, 2007, <br /> submitted to the Board this date showing the creation of <br /> two new lots, subject to Mr. Rowley' s letter dated February <br /> 7, 2007 regarding completion of bounds for the road layout <br /> and a revision of said plan indicating the location of <br /> bounds; which Motion was duly seconded by Lee Gurney and so <br /> voted unanimously. <br /> Public Hearing <br /> Bayswater Development LLC-Seanest Drive <br /> Approval of Definitive Subdivision Plan <br /> The appointed hour having arrived the Chairman read <br /> the Public Hearing notice .into the record and called the <br /> Public Hearing to order. <br /> The Chairman recognized Lawrence Carr, representing <br /> Applicant, who made reference to the original Flat Pond <br /> Subdivision Plan prepared for the previous owner, Mr. <br /> Burden. <br /> He made reference to the current Flat Pond Subdivision <br /> as presented by New Seabury Properties. A number of lots <br /> to the- south are not currently included as part of the <br /> subdivision because the land wa-s sold to the Commonwealth <br /> of Massachusetts some years ago. There was a paper street <br /> called Whimbrel Lane on which a series of lots were to have <br /> been developed. The Commonwealth continues to retain the <br /> right over the roadway (the lots do not exist without the <br /> roadway) . <br /> Applicant intends to petition the Commonwealth, <br /> Department of Conservation/recreation to relinquish their <br /> nights to the roadway. The Commonwealth Agency has <br /> indicated that they are amenable to the change, however the <br /> process will take some time. <br /> 4 <br />
