Paring issues <br /> however, would need to be addressed. <br /> There was -some discussion regarding the permitted <br /> density cap and open space issues . Applicant would be <br /> seeking approval of fire additional permits . <br /> The Town Pl .nher noted that it is possible to modify <br /> the Special Permit under the original terms. However, <br /> Planning Board interpretation is required of the fallowing <br /> provision: "...under the provisions of the zoning bylaw <br /> applicable to the original Special Permit approval., <br /> provided that there is no increase in the number of <br /> dwelling units allowed by said Special Permit nor any <br /> decrease in the area of protected open space..." <br /> The Town Planner also -cited "...For a cluster <br /> subdivision or multi-fam- ily development previously approved <br /> by the Planning Board, the Board may approve a modification <br /> expanding the land area of the project under the provisions <br /> of the zoning bylaw applicable to the original Special <br /> Permit approval provided that there is r� increase in the <br /> number of dwelling units allowed by said Special, Permit or <br /> any decrease in the area of protected open space. <br /> It was the general consensus of the Planning Board t <br /> approve this proposal when presented formally, subject to <br /> parking cons ide rat i-on s and concerns . <br /> Approval Not Required <br /> Mashpee 130 Shops, Inc. -Corner of Rte. 130 and Ashumet Road <br /> Signature of Revised Three-Lot Plan <br /> The chairman called this matter to order and <br /> recognized Richard Laroue, Land Surveyor, repre enting the <br /> Applicant. <br /> Applicant submitted a plan entitled, "Plan of Land on <br /> Main Street and Ashumet Road in Mashpee, MA, dated May 18, <br /> 2.007, by Cape Surveyors, for Mashpee 130 Shops, Inc. , <br /> Quail Run Foad, Norfolk, M ". <br /> 4 <br />
