Planning Board, the Board Secretary duly notarized one I <br /> original and three copies of said document entitled, <br /> ..Special Permit Decision, Raymond C. & Gail. s. Lopes, <br /> Proposed Common. Driveway 25. & 27 Melissa Avenue" . <br /> Preliminary Subdivision <br /> Steven Giatrelis -- 5 -Main street <br /> Approval of -Lot Preliminary subdivision Plan <br /> The Chairman called this matter to order and <br /> recognized Attorney Kevin Kirrane,, representing the <br /> Applicant. <br /> Attorney Kirrane explained that Lot #3 is the subject <br /> ranter of a Comprehensive Permit granted by the Zoning <br /> Board of Appeals in connection with the development of 120- <br /> nits of housing. It is the opinion of the Zoning Board of <br /> Appeals that a driveway has been created from Route 130 to <br /> said parcel; however Applicant argues that the significant <br /> engineering and design is that of a roadway, <br /> The ZoningBoard of Appeals has suggested that <br /> Applicant appear before the Planning Board for approval of <br /> said road as a s bdivi-sion roadway. <br /> References were made to a Plan of Lard entitled, <br /> "Subdivision of Land Located in Mashpee, MA, prepared for <br /> A I JJT, LL ., 68 NicolettalsWay, P a hpe , MA, dated July <br /> 25, 2007, by Cape & Islands- Engineering" . <br /> An ea-sement has been created and executed by all <br /> parties, which is -being held by the owner of the adj acert <br /> properties pending completion of certain construction. , <br /> When construction is completed and full consideration has <br /> been paid, said easement will be recorded. <br /> The Town Planner made reference to a letter received <br /> from the Consulting Engineer, as well as the Board of <br /> Health Agent in this matter. <br /> -After some discussion regarding drainage, erosion and <br /> buffer issues, and review of the plans, the Chairman <br /> entertained a motion. <br /> NOTION : Dennis Bal aria-i made a Motion to approve the <br /> Preliminary Subdivision Plan in this matter subject to <br /> Conditions stated in Mr. Rowley' s letter dated August 15, <br />
