• <br /> Wind chime: Approval of Phase 11 Site_Plan Revisions <br /> Tom Fudala began discussion by stating that approval cannot move forward without <br /> drainage calculations. <br /> Stu Bornstein provided a conservation easement which was drawn up'by Pat Butler. <br /> Tom said that-this was not in accordance with the special permit and did not give free <br /> title to the land. He also noted that this should have been done long ago. Stu insisted <br /> that easement could be easily changed to mean deed. The Board was n t in agreement <br /> with this. Beverly insisted on strict conformance to special permit, which she noted they <br /> all worked on for a long time, before Phase rl begins. Matt said he wanted to this report <br /> forwarded to counsel for review to see if an easement was the legal equivalent of a <br /> deed. <br /> Counsel for Trustees} Att . Brady, spoke briefly about the problems with easement vs. <br /> deed and requested a copy of Stu's report. <br /> Discussion moved on to drainage calculations. Torn said that Charlie had just received <br /> the calculation that morning and did not have time to review yet. <br /> Mike Nadeika provided "as builts" for Phase I. He also provided plans for Phase 1, and <br /> IB. Atty. Brady noted Trustee's concerns that Phase l be completed and conveyed <br /> before Phase I begins. Beverly rem 1*nded that once the Board receives all plans, it has <br /> thirty days to review and inspect. <br /> Matt noted separate revegetation plan and requested more detailed plans for Uas <br /> builts." Torn concurred that the "as builts" needed more detail; utilities, sewer lines, <br /> manhole elevations. Board expressed some confusion about "as builts" noting that the 4 <br /> wording on the pIans-stiII showed cornpfeted iterns. as being proposed. Arnie penned this modification on the plans, as indicated. <br /> Stu requested a grant to construct two buildings. Matt'insisted that no approval can be <br /> granted until.there is a certificate of compliance. Stu continued to push for swift <br /> approval. There was lengthy review/discussion of square footage calculations. There <br /> was some confusion by the Board as to where garages figure into the calculations. Torn <br /> read from special permit #15 regarding garages. Stu insisted that garages are not part . <br /> f living area. There is some disagreement on,this. Stu wanted to review Minutes of five <br /> gears ago in which he says this issue was already discussed and approved. He then <br /> said if the garages were going to be an issue, could a public hearing be held regarding <br /> modification of garages to get this issue out of the gray. Beverly wanted to first <br /> determine what the special permit requires. Torn read from special permit regarding <br /> open space. <br /> Ik <br />
