F �- <br />Mashpee Zoning <br />Board of Appeals Minutes <br />• 2 January 9, 2008 <br />thanks the Board for their time and will move forward with more <br />formalized plans. <br />Continued Matters <br />Carol Kelley: Requests a Special Permit from Section 174-17 of the <br />Zoning By-laws in order to alter a pre-existing non -conforming <br />structure and build a detached garage on property located in an R-3 <br />zoning district at 174 Captains Row (Map 96 Parcel 30) Mashpee, MA. <br />Carol Kelley: Requests a Variance from Section 174-31 of the <br />Zoning By-laws to seek a variance on a previously existing deck for <br />setback requirements on property located in an R-3 zoning district at <br />174 Captains Row (Map 96 Parcel 30) Mashpee, MA. <br />Sitting: Robert Nelson, James Reiffarth, George Bolton and William <br />Blaisdell (Zella Elizenberry and Jonathan Furbush are absent, <br />however, William Blaisdell was present during previous hearing and <br />• able to vote) <br />Brian Harris from Bennett Engineering, will move forward with <br />the hearing and is comfortable with the four sitting members. The <br />Board left Mr. Harris at the hearing on December 12, 2007 with the <br />job of pushing the garage away from the lot line and clipping the <br />corner of the existing deck so it sits at 10 feet from the lot line in <br />order to satisfy Mrs. Marilyln Sinkiewicz's letter that was submitted to <br />the Board regarding the existing deck and her request to have no <br />new construction closer to her home/lot line. Although the deck was <br />previously existing, the Kelley's were amenable to clipping the edge <br />of the deck to keep it 10 feet from the lot line. The Board <br />appreciated his effort to comply with the neighbor's request. <br />Additionally, Mr. Harris told the Board that the septic system has <br />been turned to align with Captain's Row at a better angle and the <br />garage is now attached to the main dwelling and the driveway will be <br />made out of porous pavement. Mr. Nelson thanks Mr. Harris for <br />completing the new plot plan with the requested changes. James <br />• Reiffarth makes a motion to grant the Special Permit. Robert Nelson <br />seconds the motion. All agree. So moved. Suecial Permit is <br />conditioned on plans from Bennett Engineering, dated November 30, <br />2007, revised January 9, 2008.
