2 <br />Zoning Board of Appeals <br />Minutes <br />June 27, 2006 <br />A memorandum was received from Mr. Storrs dated June 26, 2006 on <br />behalf of Jobs/Whitings Trust relative to the referenced Chapter 40B <br />submittal. The Board reviewed the updated document with Mr. Storrs. <br />At the last meeting, the Town Planner stated the ZBA was limited to a <br />minimum of 20' of frontage for any lot under State law. Included in Mr. <br />Storrs memorandum was a copy of a note from Attorney Peter Freeman <br />indicating the Board can approve lots of any amount of frontage and is <br />therefore, not limited to a minimum 20' frontage. The matter was briefly <br />debated between the two attorneys. It was agreed the issue would be <br />further addressed by representing counsels. <br />It was also disclosed that a Professional Services Account has been <br />established with the Town of Mashpee to provide payment for special <br />counsel Talerman and for Mr. Rowley's engineering services associated to <br />the Jobs/Whitings project proposal. The review and related payment <br />process was detailed in the referenced memorandum addressed to the <br />• Zoning Board of Appeals. <br />Minor amendments were incorporated into the schematic to provide for <br />adequate parking. The plan was moderately revised to incorporate <br />refinements in accordance with recommendations of the ZBA Board. <br />As noted, (1) the Patio Homes are now. three six 6-plex apartment building <br />units, a total of 18. From a design perspective, the shift configures the <br />buildings in a more logical manner and incorporates an additional <br />landscape area. Parking allows for one space per one bedroom unit with a <br />few additional spaces defined in a design which improves traffic flow and <br />the relationship of the buildings situated on the street. <br />(2) One of the Townhouses (Lot 200) has been eliminated from the plan. <br />The alteration of Lot 201 supports the 6-plex apartment (adjacent to <br />Homeyer Village) and presents a more efficient method of access adding <br />additional buffer areas. The six units have ten parking spaces in modified <br />positions. <br />(3) The proposed retail/office space has been reduced from Building 127 <br />from 6,250 square feet to 4,700 square feet. Amendments have eliminated <br />commercial space along Meeting Street. The commercial buildings will <br />• now be located on Jobs Fishing Road only in the revised configuration. <br />
