4 <br />• Zoning Board of Appeals <br />Minutes <br />November 28, 2006 <br />DECISIONS AND CONDITIONS: <br />14. Shadow Parking: If the need for parking mandates the addition of one <br />additional space, all live works shall delineate (1) additional parking <br />space. A noted easement provision in the deed. RESOLVED. <br />"The architect was directed to present a Master Use Schedule for <br />Commercial Spaces to the ZBA Board for additional review. <br />6. Phasing: Due to economics as it relates to market and affordability, the <br />applicant was granted flexibility to present the project in (7) phases of <br />construction. It was agreed the applicant would meet before the ZBA <br />Board every six months to discuss and provide written reports regarding <br />the progress of construction. Minor, insubstantial changes would be <br />permissible. Major, substantial changes would require the applicant to <br />come before the full ZBA Board. <br />• Last sentence: Should any aspect of the Project's construction cause <br />adverse impacts to local concerns, the Board may issue orders to abate <br />such impacts, as allowed under 760 CMR 31.09(4). Special Counsel was <br />requested to narrow the language to address the applicants concerns <br />regarding enforcement. <br />17. Of the proposed units, 96 shall be restricted, in perpetuity for sale or <br />rental to households earning no more than 80% of the AMI. So as to <br />provide a window of affordability, the actual rents or sale prices of these <br />affordable units shall be an amount that is deemed affordable to <br />households earning no more than 70% of the AMI. <br />The above shall reference MassHousing standards. It was agreed that <br />representing counsels would further review this item. <br />With respect to this regard, correspondence was received from the <br />Affordable Housing Committee requesting a timeline for completion. In <br />response, the applicant indicated that an open line of communication <br />would be maintained regarding construction of the affordable units, the <br />lottery and other related matters. <br />18. A lottery shall be established in a form approved by DHCD to <br />effectuate local preference. <br />
