Mashpee Zoning <br /> Board of Appeals Habitat for Humanity of Cape Cod, Inc. <br /> 562 Cotuit Road <br /> 2 SP-06-85 <br /> were present and acting throughout: Robert Nelson,Zella Elizenberry, Marshall Brem, <br /> Jonathan Furbush and Frederick Borgeson. <br /> Upon closure of the public hearing, and vote of the Board, the Mashpee Zoning <br /> Board of Appeals issues this Decision pursuant to the provisions of Massachusetts <br /> General Laws, Chapter 40B, §21 and applicable Town of Mashpee Zoning Bylaws. <br /> FINDINGS <br /> 1. The subject property is located at 562 Cotuit Road, and contains approximately <br /> 12,500 sq. ft. with 100' of frontage on Cotuit Road. <br /> 2. The subject property is located in an R-5 Zoning District, which pursuant to <br /> Mashpee Zoning By-law, §174-31 requires 80,000 sq. ft. as a minimum lot size and 150 <br /> ft. as minimum lot frontage. <br /> 3. The Petition for a Comprehensive Permit to build a single family three (3) <br /> bedroom residence at the subject property was accompanied by appropriate <br /> documentation confirming the Commonwealth of Massachusetts, Department of Housing <br /> & Community Development's determination of site eligibility and preliminary approval <br /> under the Local hlitiative Program (LIP) for the proposed project, subject to certain <br /> conditions set forth therein. <br /> 4. The applicant's representative at the public hearing indicated its intent to maintain <br /> the proposed residence as affordable housing in perpetuity. <br /> 5. There is, at the present time, a need for development of low income and <br /> affordable housing in the Town of Mashpee and in the Upper Cape Cod region. <br />
