C. 40B, $$20-23 <br /> APPLICANT: ABKJJT, LLC and Mashpee Woods Development, LLC (the <br /> "Applicant") <br /> PROPERTY: 588 Main Street, Route 130; Assessor's Parcels: Map 19, Parcel 10 <br /> (the "Property") <br /> DATE: June 12, 2007 <br /> L PROCEDURAL-HISTORY AND JURISDICTIONAL FINDINGS <br /> 1. Application for so-called Comprehensive Permit received by the Mashpee Zoning <br /> Board of Appeals (the "Board") on November 21, 2006. The application is for <br /> 120 housing units on an approximately 32 acre portion of a 48 acre parcel off of <br /> Route 130 (the "Project"). The Application proposes 96 home-ownership <br /> condominiums and 24 rental units in five similarly designed garden style <br /> buildings. The Application also included so-called "project eligibility letters"the <br /> Department of Housing and Community Development (DHCD). <br /> 2. The Applicant proposes to be a limited dividend corporation. Accordingly, the <br /> jurisdictional requirements tinder 760 CMR 31.01(1)(a) have been satisfied. <br /> 3. The subsidizing agency is DHCD. Per a letter from DHCD, dated October 31, <br /> 2007, project eligibility has been granted under the Local Initiative Program for <br /> both the rental and home-ownership components of the Project. Accordingly, the <br /> jurisdictional requirements under 760 CMR 31.01(1)(b) have been satisfied. <br /> 4. The Applicant possesses an interest in the site by virtue of the fact that ABKJJT, <br /> LLC owns the main portion of the Property. Additionally, there is a tentative <br /> agreement between ABKJJT, LLC and an adjacent property owner for an access <br /> Mashpee Woods-final permit—6/12/08 I <br />
