Mashpee Zoning <br />Board of Appeals Minutes <br />• 4 July 2005carsCrossing. The residents did not want cars too be able to go through Deer Crossing so a <br />gate will be placed at the end so that only emergency vehicles can traverse the area. The <br />residents are comfortable with this proposal and have worked with the applicant through <br />the planning board at several meetings. <br />The utility easement on the lot made it necessary to obtain a variance for lot size since the <br />easement greatly reduced the size of the lot. Attorney Kirrane goes through each criteria <br />of the requirements for a special permit and submits that the applicant meets them all for <br />this permit to be granted. The Board questions the owner regarding the traffic that will <br />enter and exit from Route 28. Mr. Conway explains that most of the heavy traffic will be <br />only twice a year, once in the spring and once in the fall when the boats will be put away. <br />He informs them he intends to have a wholesale business by contract and not for <br />individual use. He has one for a boat hauler and one for a marine use facility. Mr. Nelson <br />raises concerns about the potential accidents that may occur due to the topography of <br />Falmouth Road and a large boat hauler trying to obtain access to the facility. He would <br />like to discuss this matter with the Chief of Police to get his imput on a right turn only <br />into Wags Road. The matter is suggested to be continued until August l0'h for further <br />research. Attorney Kirrane agrees. So moved. <br />Weston Stow: Requests a Variance from Section 174-31 of the Zoning By-laws to vary <br />the setback requirements in order to build a 22' x 12' detached garage/shed on property <br />• located in an R-5 zoning district at 19 Warwick Way (Map 15 Parcel 18) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and James <br />Reiffarth. <br />Attorney Kevin Kirrane represents the applicant at this hearing. He is seeking a variance <br />in order to build a one car shed style detached garage and cannot maintain his 25 foot <br />setback requirements or his 40 foot front yard setback requirement. Applicant is an <br />elderly man who needs a garage to maintain his vehicle and other storage items. The lot <br />has specific topographical problems which prevents him from moving it any further back. <br />Mr. Brem states that he visited the area and feels this will enhance the neighborhood. <br />Abutters Henry and Rachel Catsoulis support the project as they are direct abutters. <br />Marshall Brem makes a motion to grant a 14.5 foot variance from the front and a 9.5 foot <br />variance on the side. Zella Elizenberry seconds the motion. All agree.
