Mashpee Zoning <br />Board of Appeals Minutes <br />5 July 27, <br />balcony cantilevers on the side they must get a special permit to alter apre-existing non- <br />conforming structure since the area cantilevered over would not meet the current setback <br />requirements. There are several houses in this area that are very tightly built onto small <br />pieces of land. The footprint has not changed but the building department felt this permit <br />was necessary. The Board feels the special permit request is reasonable and Zella <br />Elizenberry moves to grant the special permit. Marshall Brem seconds the motion. All <br />agree. So moved. Reference plans from Holms and McGrath of Falmouth, MA, Job No. <br />201420, dated January 23, 2002. <br />Mark Ducharme/Coastal-N=Counters: Request a Special Permit from Section 174- <br />25(G) 4 and 5 of the zoning by-laws to manufacture and repair counter tops on property <br />located in an I-1 zoning district at 103 Industrial Drive (Map 88 Parcel 28) Mashpee, <br />MA. <br />Sitting: Robert Nelson stepped down from this hearing. Zella Elizenberry, Marshall <br />Brem, Jonathan Furbush, Eric Dublirer and James Reiffarth. <br />John Slavinsky of Cape & Islands Engineering represents the applicant at this hearing. <br />They are seeking a special permit to have his company Coastal -N -Counters be able to <br />conduct business at this new location and be able to continue to manufacture and repair <br />counter tops and possibly add a granite line as well down the road. They have met with <br />the Technical Review Committee and the Board of Health and the Planning Board have <br />approved this as well. The parking will be paved and the fence that is there will remain <br />and the area will be fenced in. The septic system must be outside the Mashpee <br />recharging zone. Applicant is aware of this and all requests will be taken care of. The <br />Board of Health has the following comments: <br />Hazardous materials shall be limited in volume to 200 pounds dry weight <br />and 220 gallons of liquid storage. Hazardous waste shall be limited <br />according to 310 CMR 30.00 Massachusetts Hazardous Waste <br />Regulations. Storage of hazardous materials outside is prohibited. <br />All changes in tenancy and/or use of the facility shall be approved by the <br />Board of Health prior to issuance of a lease or sale of the property. <br />The Board discusses the request for a landscaping Bond. It is decided a $5,000 bond <br />would be sufficient. Marshall Brem makes a motion to grant the special permit and to <br />have applicant post a $5,000 bond for landscaping. Zella Elizenberry seconds the <br />motion. All agree. So moved.
