Mashpee Zoning Lighthouse Place, LLC
Board of Appeals Geoffrey and Janet Willis
2
 SP-05-102
the project. The site is situated in the commercial zoning district. Off ice use is
permitted in this district upon the grant of a special permit. The site is non-conforming
given both its size and frontage. The building itself conforms to the current setback and
will continue to conform after the addition is built. The property was initially developed
in accordance with a special permit in 1985. The applicant is providing sufficient off
street parking and has designed a drainage system on-site to ensure that all surface water
will be disposed of on site. The Board reviews the plans. Mr. Nelson would like to see
the dumpster moved five feet toward Cape Drive. Mr. Kirrane says that wont be a
problem. The Board would also like to see the trees kept between the restaurant and the
building for screening and if approved this must be conditioned on approval from the
Board of Health. The Board asks if they have any prospective tenants yet. They do not
have anything official at this time. It is the general consensus of the board that this will
not be detrimental to the neighborhood. Since there are no abutters present with any
concerns or comments, the board feels this is a reasonable request.
Special Permit Criteria
§ 9 of Chapter 40A requires:
"that the permit granting authority determine that the proposed use and
development are consistent with applicable law, rules and regulations; that there
will be no adverse effect on public health or safety;that there will not be an
excessive demand upon community facilities created as a result of the proposal;
and that there will not be a significant adverse impact on the environmental
factors listed in Section 174-24.C.2.".
§ 174-24.C.2 states:
"A special permit may be issued only following the procedures specified by the
General Laws and may be approved only if it is determined that the proposed use
or development is consistent with applicable state and town regulations, statutes,
bylaws and plans, will not adversely affect public health or safety, will not cause
excessive demand on community facilities, will not significantly decrease surface
or groundwater quality or air quality, will not have a significant adverse impact
on wildlife habitat, estuarine systems, traffic flow, traffic safety, waterways,
fisheries, public lands or neighboring properties, will not cause excessive levels of
noise, vibrations, electrical disturbance, radioactivity or glare, will not destroy or
