taking our view away, the plantings of Arborvitaes being planted will obstruct our view. All
changes potentially cause stormwater runoff into the reserve area.
We bought this house because of the view, we've contacted our HOA. We appreciate you're
listening. Our Association protects our property values and views.
Mr. Smith commented that the purview of the Commission is to examine Town by laws for the
purpose of Conservation.
Tom Bunker said he understands the concerns. Zoning does not allow a hill to be created and
have a house built 35ft tall on top of that. Retaining walls are not making it a taller house.
Andrew Garulay said all elevations are based on sea level.
Matt Costa from Cape and Islands Engineering was present and asked to call Point of Order
to the meeting.
Agent said these are relevant concerns that need to be discussed.
Tom Bunker and Andrew Garulay explained the design of the wall and how there's not going
to be runoff. Agent asked if it will interfere with drainage, Tom Bunker said no.
Tom Bunker said this is going to the Board of Appeals where there is more leeway for
abutters to voice their concerns.
Agent said views are more under Zoning's purview, drainage is ours. One boilerplate
condition regarding runoffs is if construction results in more runoff, they will be required to
address that.
Mr. Sweet motioned to close and issue.
Mr. Weeden seconded the motion.
Vote: 5-0-0
Roll Call Vote:
Mr. Weeden; yes
Mr. O'Neill; yes
Mr. Sweet; yes
Mr. Colombo; yes
Mr. Smith; yes
In favor, 5; Opposed, 0; Abstentions, 0
6:27 Paul M. and Madeline J.
