Mashpee Zoning <br /> Board of Appeals Minutes <br /> 2 Public Hearing <br /> March 10, 2004 <br /> property located in an R-3 zoning district at 33 Shoestring Bay Road (Map 84 Parcel 24) <br /> Mashpee, MA. <br /> No one showed up for this hearing. However, due to a set of upgraded plans being <br /> dropped off on March 9, 2004, the Board suspects that along with the letter in the file that <br /> they are still waiting to get through conservation. This matter will be continued until <br /> March 24, 2004. <br /> Michael Aucoin: (Informal Discussion) <br /> Mr. Aucoin is before the Board to discuss his options and what the Board would like to <br /> see from him in order to deem a lot buildable on Lincoln Way and Cotuit Road. The lot <br /> currently has no frontage but Mr. Aucoin would like to present an option of obtaining <br /> some frontage, and a variance so that he has the 150' required for buildable lots. He <br /> discusses the paper road Lincoln Way and whether or not that would need to be <br /> developed. Mr. Aucoin would like to know what the thoughts of the ZBA are at this time <br /> and the Planning Board as well. Mr. Aucoin shows the Board a small portion of land that <br /> he may be able to get deeded to him which does contain some frontage. He would then <br /> need to come before the Board for a variance for the difference to 150 feet. They discuss <br /> several options and Mr. Aucoin will come back with some solid plans and ideas. <br /> Kenneth Konikowski: Requests a Variance from Sections 174-31 and 174-33 of the <br /> Zoning By-laws to seek relief from the current sideline setbacks, front yard setbacks and <br /> distance to the wetlands setback requirements in order to construct a garage and additions <br /> to the main dwelling on property located in an R-3 zoning district at 95 Whippoorwill <br /> Circle (Map 125 Parcel 152) Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry and Richard Guerrera. <br /> Michael Grotzke of The Phoenix Group represents the petitioner at this hearing. Mr. <br /> Nelson would like to read a memo from Glenn Harrington, Board of Health Agent, which <br /> states there are several unresolved issues regarding this petition. The septic system was <br /> built and designed for a 3-bedroom house and there currently exists a 4-bedroom house. <br /> There are wetlands issues and a number of things that have not been settled with the <br /> Board of Health by Mr. Grotzke. Mr. Groktze informs that Board that he intends to <br /> rectify the situation with Mr. Harrington, however, he feels his presentation with the ZBA <br /> has nothing to do with pending issues before the Board of Health. Mr. Nelson informs <br /> Mr. Grotzke that the ZBA only meets with a potential petitioner once all issues with <br /> Board of Health, Conservation and any other board that may require approval. Mr. <br /> Grotzke would like to proceed with his presentation—he is denied by the Board at this <br /> time until all issues have been dealt with in the Board of Health.
