Mashpee Zoning <br /> Board of Appeals Minutes <br /> 3 July 14, 2004 <br /> David Sanicki of Cape & Islands Engineering represents the applicant at this hearing. <br /> They are seeking a special permit for the demolition of the existing dwelling at 688 Great <br /> Neck Road, South and to build a 5-bedroom dwelling in its place. Mr. Sanicki informs <br /> the Board that it is in the flood zone after Mr. Nelson inquires if the property will exist 11 <br /> feet below the flood zone. There will be new septic systems, which will enhance the <br /> property and area. An abutter, Marsha Coughlin, who lives at 693 Great Neck Road, <br /> South was interested in the project and would like to know how high the house will be. <br /> She mentions that her property was sold to her with a view of Ockway Bay and that will <br /> be disturbed if this house is built. Mr. Regan in forms her that the views of abutters is not <br /> of concern to the ZBA. Marshall Brem moves to grant the special permit. Robert Nelson <br /> seconds the motion. Mr. Regan votes favorably. Mr. Guerrera votes favorably. So <br /> moved. Reference plans from Cape & Islands Engineering, dated June 9, 2004, DEP SE <br /> 43 2057 as prepared for Mashpee Realty Investors LLC. <br /> Richard Weymouth: Requests a Variance from Section 174-31 of the Zoning Bylaws to <br /> seek relief from the backyard setback requirements to build a proposed garage and to <br /> legalize an existing deck on property located in an R-5 zoning district at 35 Vista Circle <br /> (Map 60 Parcel 79) Mashpee, MA. <br /> Richard Weymouth represents himself at this hearing. He is seeking a variance to <br /> legalize and existing deck and relief from the rear yard setback requirements in order to <br /> build a garage. The Board reviews the plans with applicant and measures a couple of <br /> spots on the plan. It is determined that he will need 6.5 feet on the southerly side and <br /> 12.1 feet to legalize the deck. Total lot coverage with the proposed garage will be 12.8%. <br /> Marshall Brem makes a motion to grant a 6.5-foot variance on the southerly side of Vista <br /> Circle and a 12.1-foot variance in the rear yard to legalize the deck. Richard Guerrera <br /> seconds the motion. Robert Nelson votes favorably. James Regan votes favorably. So <br /> moved. Reference plans from BSS Design of Falmouth, MA, dated June 10, 2004, no. <br /> D7-315. <br /> Richard Kearney: Requests a Special Permit from Section 174-17 of the Zoning By- <br /> laws to alter a pre-existing non-conforming structure on property located in an R-3 <br /> zoning district at 429 Monomoscoy Road (Map 124 Parcel 54) Mashpee, MA. <br /> Attorney Kevin Kirrane represents the applicant at this continued hearing. Robert Nelson <br /> informs Mr. Kirrane that since the ZBA has gone to a 5-person board and they only have <br /> the minimum of 4 people here this evening, he has the right to continue the matter to have <br /> 5 people vote on this matter since there is some controversy on the matter. He confers <br /> with his client and they opt to wait for the full 5-person board to convene. Matter is <br /> continued until July 28, 2004. <br /> Plymouth Savings Bank: Requests a Variance from Section 174-31 of the Zoning By- <br /> laws seeking relief from the setback requirements in order to build an addition to the <br /> existing business on property located in a C-1 zoning district at 6 Shellback Way (Map <br /> 81 Parcel 36) Mashpee, MA.
