T, Mashpee Zoning <br /> Board of Appeals Minutes July 28, 2004 <br /> 4 <br /> Brem makes a motion to grant a 10-foot variance to the sideyard setback requirements. <br /> Robert Nelson seconds the motion. All agree. So moved. Reference plans from Cape & <br /> Islands Engineering, dated December 10, 2003, revised February 14, 2004, revised June <br /> 1, 2004, File No. 104MA. <br /> Robert Zarum: Requests a Variance from Section 174-31 of the Zoning By-laws to <br /> vary the setback requirements in order to build a 36' x 30' addition on property located in <br /> an R-3 zoning district at 10 Neshobe Road (Map 125 Parcel 107) Mashpee, MA. <br /> Sitting: Robert Nelson, James Regan, Marshall Brem and Richard Guerrera. <br /> John Slavinsky of Cape & Islands Engineering represents the petitioner at this hearing. <br /> They are seeking a variance from the setback requirements in order to build an addition <br /> to their house. The pavement is 60 feet out of position in the frontyard creating a <br /> hardship for the petitioner to meet the setbacks. The frontyard setback was originally 20 <br /> feet in 1969 when the lot was created and was conforming at that time. The lot coverage <br /> is 18.4% and the Board feels this is reasonable. Robert Nelson makes a motion to grant a <br /> 21-foot variance on Neshobe Road. Marshall Brem seconds the motion. All agree. So <br /> moved. Reference plans from Cape & Islands Engineering, dated May 3, 2003. <br /> Willowbend Country Club: Request a Special Permit from Section 174.25.I.9 of the <br /> Zoning By-laws in order to build, license and maintain a pier, ramp and float on property <br /> located in an R-3 zoning district at 37 Shoestring Bay Road (Map 84 Parcel 25) Mashpee, <br /> MA. <br /> (Called for the second time) <br /> No one is present for this hearing. The Board feels that since this has been continued 3 <br /> times, they will deny the motion without prejudice and must re-file. The continuances <br /> are getting too confusing with all of the different plans being submitted, <br /> Marshall Brem makes a motion to deny without prejudice. Richard Guerrera seconds the <br /> motion. All agree. So moved. The Special Permit request is denied without prejudice. <br /> Plymouth Savings Bank: Requests a Variance from Section 174-31 of the Zoning By- <br /> laws seeking relief from the setback requirements in order to build an addition to the <br /> existing business on property located in a C-1 zoning district at 6 Shellback Way(Map <br /> 81 Parcel 36) Mashpee, MA. Owner: Charles C. Hajjar Trust, Falmouth Road Trust <br /> Plymouth Savings Bank: Requests a Special Permit from Section 174-54 of the Zoning <br /> By-laws in order to have signage and illumination in a commercial district on property <br /> located in a C-1 zoning district at 6 Shellback Way (Map 81 Parcel 36) Mashpee, MA. <br /> Owner: Charles C.
