Mashpee Zoning
Board of Appeals Minutes July 28, 2004
5
At this continued hearing present for the applicant is Attorney Kevin Kirrane, Mr. Lou
Krueger, Senior Vice President for Plymouth Savings Bank are before the board to
discuss the Special Permit request currently before the board for the expansion of
Plymouth Savings Bank. The current parking issues and driveway arrangements are
presenting problems for residents of Deer Crossing both commercial and residential. The
current parking in front of True Value Hardware does not comply with the parking by-
law. Mr. Kirrane and the Board again go over the details of the driveway arrangements
and parking situation. There are many people that have businesses in Deer Crossing that
feel that the proposed parking arrangements will be detrimental to their livelihoods. The
Talanian project is requirement to maintain a 2 lane driveway on Shellback Way that was
part of their comprehensive permit. Tom Fudala was supportive of this arrangement as is
Plymouth Savings Bank. Mr. Kruger will accommodate whatever they can to make
everyone happy, however, they cannot fix the parking in front of True Value. Mr.
Kirrane mentions to the Board that there was never any legally granted parking. The
Board would like to see what the original configuration of parking was and to possibly
have this new parking proposal re-arranged. Several comments were made from other
businesses in the Deer Crossing as well as residents of Deer Crossing Condominiums.
Sally Gold and Paul Gentile: Deer Crossing Condominiums— she would like this
cleared up, the entrance off of Shellback Way was originally paved by Mr. Capizolli and
done without permission. They discuss the safety issues whereby a child was almost hit
by a car backing up. The traffic both in and out of the entryway in front of True Value is
very dangerous.
Charles Lasalla owner, True Value: He mentions to the Board that if the parking is
removed in front of his store, he would suffer financially.
Mark Ducharme, owner of Coastal n Counters: He inforrns the Board that the
overflow of cars from True Value park in front of his business and this is a problem since
his customers are not just in an out.
Charle Hai iar, Owner of Deer Crossing Development: Mr. Hajjar wants to make
everyone happy. He is currently in the middle of a large Title V problem with the whole
complex. Mr. Talanian wants the 2 way street on Shellback Way completed, which
would enhance the complex. He would like to work everything out with everyone.
Cliff Peterson: He is resident of Southport and would like to know who will be
enforcing the parking? The Board informs him that it would up to the Building Inspector
to enforce the Special Permit since he is the Zoning Enforcement Officer.
Fred Stearn: A trustee of the Deer Crossing Condominiums, he is also concerned about
the entrance in front of True Value as well. He feels the traffic is a problem as well.
Noah Greenburg, Architect Mr. Greenburg addresses the plans with the Board. Mr.
Regan mentions it is best not to beat a dead horse at this point.
