Reference <br /> plans from Design Phase as prepared for John Vidal dated July 6, 2004. <br /> Charles and Jean Viglas: Request a Special Permit under Section 174-25 L9 of the <br /> zoning by-laws in order to reconstruct and license a pier, ramp and float on Spoondrift <br /> Cove on property located in an R-3 zoning district at 10 Spoondrift Circle (Map 111 <br /> Parcel 117) Mashpee, MA. <br /> Charles and Jean Viglas: Request a Special Permit under Section 174-20 of the zoning <br /> by-laws in order to demolish existing single family residence and construct a new <br /> dwelling on property located in an R-3 zoning district at 10 Spoondrift Circle (Map 111 <br /> Parcel 117) Mashpee, MA. <br /> Charles and Jean Viglas: Request a Variance from Section 174-31 of the zoning by- <br /> laws to vary the current setback requirements in order to build a new dwelling on <br /> property located in an R-3 zoning district at 10 Spoondrift Circle(Map 111 Parcel 117) <br /> Mashpee, MA. <br /> David Sanicki of Cape & Islands Engineering along with Anthony Ferragamo, Ferragamo <br /> Engineering, represents the petitioners at this hearing. They are seeking a special permit <br /> for a pier, ramp and float that Mr. Sanicki is handling and a special permit to demolish <br /> the existing structure and build a new house along with a variance for relief from the <br /> setback requirements in order to complete the proposed dwelling,that Mr. Ferragamo is <br /> handling. The house was built in 1967 and was built 2 feet over the property line on <br /> abutter's property. This matter must be rectified. Mr. Ferragamo proposes to slide the <br /> new dwelling over while maintaining the 15-foot side yard setback requirements. They <br /> will not however, be able to maintain the 40-foot front yard setback requirement and need <br /> a variance for this aspect of the project. There will be a new septic system and the <br /> petitioner has obtained a letter from the abutter allowing them on their property to rectify <br /> the situation. The pier, ramp and float plans are reviewed by the Board as well as the <br /> new house plans with the engineers. The Board feels this will be an improvement to the <br /> area and sooner or later, the house would need to be moved off the abutting property <br /> owners land. Robert Nelson moves to grant the following: <br /> ✓ A special permit for a pier, ramp and float <br /> ✓ A special permit for the demolition and rebuild of a new dwelling <br /> ✓ A 22,255 landspace variance <br /> ✓ A 6.45 foot frontage variance <br /> ✓ A 14 foot front yard setback variance <br /> Richard Guerrera seconds the motion. All agree. So moved. Reference plans from Cape <br /> & Islands Engineering, dated February 3, 2004 and revised June 25, 2004, and plans from <br /> Anthony Ferragamo, dated June 30, 2004 as prepared for the Viglas House. <br />
