Mashpee Zoning <br /> Board of Appeals Minutes <br /> 4 October 27, 2004 <br /> • Richard Kearney: Requests a Special Permit from Section 174-20 of the Zoning By- <br /> laws to demolish the existing dwelling and rebuild a new dwelling on property located in <br /> an R-3 zoning district at 429 Monomoscoy Road (Map 124 Parcel 54) Mashpee, MA. <br /> Sitting: .Tames Regan, Robert Nelson, Zella Elizenberry, Marshall Brem and Richard <br /> Guerrera. <br /> Attorney Kevin Kirrane along with Architect Tom O'Neil and Engineer Michael Grotzke <br /> represent the petitioner-at this hearing. This matter was continued from September 8, <br /> 2004 so that the Architect Tom O'Neil could redraw the plans showing the garage pushed <br /> back 11.5 feet. The Board again discusses with Mr. Kirrane the difference between <br /> Sections 174-17 and 174-20 since so much of this structure is coming down. Mr. Kirrane <br /> indicates that he originally filed a special permit request for 174-20 and the Board along <br /> with the former building inspector requested him to file under 174-17. After some <br /> discussion, Mr. Kirrane indicated the MGL Chapter 40 A Section 6 would clearly allow <br /> him to move forward with the special permit in this manner. They have accommodated <br /> Mr. Mark White's concerns who is an abutting neighbor to the best of their ability. Mr. <br /> White steps forward to view the plans and the Board gives them a few minutes to look <br /> them over. After some final review,of pictures of similar homes and comments from Mr. <br /> O'Neil regarding vegetative landscaping and the like, Marshall Brem makes a motion to <br /> grant the Special Permit. Zella Elizenberry seconds the motion. All agree. So moved. It <br /> is noted that the Special Permit will consist of both Sections 174-17 and 174-20. <br /> Willowbend Country Club, Inc.: Requests a Special Permit under Section 174-25 1.9 of <br /> the Zoning By-laws in order to build a pier, ramp and float on property located in an R-3 <br /> zoning district at 37 Shoestring Bay Road (Map 84 Parcel 25) Mashpee, MA. <br /> Sitting: Robert Nelson, Zella Elizenberry, James Regan, Marshall Brem and Richard <br /> Guerrera. <br /> Mr. Jack McLinney represents the applicant at this hearing. They have been granted <br /> several continuances due to issues with the Conservation Commission. The Board- <br /> reviews the plans and sees that the pier is more than 70 feet and that no variance has been <br /> filed. The Board informs Mr. McLinney that he needs to file a variance to proceed. He <br /> then asks to continue until December 8, 2004. The Board agrees. So moved. <br />
