II. DESCRIPTION OF PROPOSED MODIFICATION <br /> . 1. The proposed modification is described on the plans David Thulin, dated June 7, <br /> 2003. In basic terms, the change in the plans reflect the combination of Lots 1 <br /> and 2, as shown on the originally permitted plans, into a single lot, labeled Lot 1 <br /> on the revised plans. The change is due to an oversight on the part of the <br /> applicant with respect to drainage onto the sight from adjacent properties. <br /> 2. The Applicant also proposes the elimination of a"moderate" income unit due to <br /> the required reduction in the total number of units. Under the original permit, said <br /> moderate income unit, which was in addition to the three required affordable <br /> units, was to be restricted to sale to households earning no more than 110% of the <br /> area median income. <br /> 111. FINDINGS <br /> 1. The Board finds that the unforeseen drainage system requires the elimination of <br /> the twelfth unit. <br /> 2. The Board finds that it is vital to the Town's needs to maintain a moderate income <br /> unit. The Board also finds that the price of such moderate income unit must be <br /> increased to ensure the economic viability of the project. <br /> • 3. The Board finds that the report of Charles Rowley, dated July 21, 2003, attached <br /> hereto, provides certain additional recommendations that should be implemented <br /> by the Applicant when preparing the final plans for construction. <br /> IV. DECISION AND CONDITIONS <br /> Upon Motion of Robert Nelson, seconded by Zella Elizenbeny, the Board hereby <br /> grants the Applicant a modification to the "Comprehensive Permit" for the Meetinghouse <br /> Hill, as shown on the Plans, dated August 15, 2003, subject to the following conditions: <br /> 1. The Applicant shall retain the moderate income unit, in addition to the three <br /> affordable units. However, the price of the moderate income unit be increased <br /> such that it shall be restricted, in perpetuity, for sale to households earning no <br /> more than one hundred and thirty (130%) percent of the median household <br /> income for the area, as may be determined by reference to statistics compiled by <br /> the Department of Housing and Community Development or the Federal <br /> Department of Housing and Urban Development or the successor agencies <br /> thereto. The Applicant has noted its agreement with the imposition of this <br /> condition. <br /> 2. The location of the affordable and moderate income units shall be at the discretion <br /> of the Applicant, provided that none of three affordable units shall be on abutting <br /> • <br />
