Ms. Boutilier indicated that she would not object to the 141 <br /> II <br /> encroachment on the setback to Bluff Avenue. Mr. Nelson said that he visited the subject <br /> property and observed that the proposed location of the construction is the average <br /> setback from the street as other homes in the area. <br /> Mr. Nelson moved to grant a 5-foot Variance from the setback requirements from Bluff I <br /> Avenue, subject to criteria/findings 1, 2, 3, hardship created by septic system, which <br /> restricts location of construction, proposed construction would be further away from <br /> Bluff Avenue than original structure and Cape & Islands Engineering plan entitled <br /> `Proposed Site Plan Located in Mashpee—Mass., Prepared for Peter Maher Date: May II <br /> i <br /> 17, 2002, File: 125MA'. Mr. Guerrera seconded. All agreed. !� <br /> Mr. Nelson moved to grant a Special Permit, subject to findings 1 (does not conform), 2 - <br /> further away from setback than existing, 3 -under allowed 20% lot coverage, 4, 5 —not <br /> more detrimental, 6. Mr. Guerrera seconded. All agreed. <br /> � I <br /> Paul F. Emerson—Requests a Special Permit under Sections 174-25.G.4 and 174-25.G.5 <br /> of the Zoning By-laws to construct a commercial building to allow for upholstery of <br /> canvas and manufacturing of metal cages on property located in an I-1 zoning district at <br /> 36 Nicoletta's Way (Map 20 Parcel 56) Mashpee, MA. <br /> Sitting: James E. Regan III, Frederick R. Borgeson and Robert G. Nelson. i ! <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition along with j <br /> Mr. Emerson who also attended the meeting. Plans call for construction of a commercial <br /> building on Nicoletta's Way. Mr. Emerson is in the business of marine canvas repair, ii I <br /> boat frame and cushion construction. He said that a portion of the proposed building I I' <br /> would be rented to a manufacturer of metal cages, e.g. pet cages. <br /> The Technical Review and Design Review Committees have reviewed and approved the <br /> proposed construction. No comments were received from abutters. ;I <br /> Mr. Borgeson moved to grant the Special Permit, subject to commercial findings 1, 2, 3, <br /> 4, 5, 6 and Design Review and Technical Review findings 1, 2, 3 and posting of a j <br /> landscape and performance security (bond) in the amount of$8,000. The Special Permit ! ! <br /> is conditioned upon compliance with the following plans: <br /> 1.
