Mashpee Zoning Minutes—August 28, 2002 6 <br /> Board of Appeals <br /> Mr. Govoni moves to continue this matter to September 25, 2002 so the petitioner can <br /> obtain more research. Mr. Nelson seconds the matter. All agree. <br /> Mr. Govoni leaves the meeting at 8:15 p.m. <br /> Roderick St. Pierre—Requests a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a Section l0A pier, ramp and float on Hamblin Pond <br /> on property located in an R-3 zoning district at 261, 265 and 269 Monomoscoy Road <br /> (Map 120 Parcels 42, 41 and 40) Mashpee. MA. <br /> Sitting: James E. Regan, III, Richard T. Guerrera, Marshall Brem <br /> Norman Hayes of the BSC Group representing the petitioner, Roderick St. Pierre <br /> requesting a Special Permit to construct a pier, approved by the Conservation <br /> Commission. Mr. Hayes informs the Board the three lots have been combined to make <br /> almost one acre of property. Abutters comments: <br /> Mr. Richard Moore <br /> 21 Hamblin Road <br /> i <br /> Mr. Moore asks how many boats will be tied up to the dock? Mr. Hayes believes the <br /> owner has one boat, but cannot guarantee that is all. He refers Mr. Moore to Perry Ellis, <br /> Harbormaster for more specific information. Mr. Moore feels the property in question is <br /> an area of critical environmental concern. Via, <br /> Marshall Brem moves to grant the following: <br /> ♦ Permission to construct a Section 10A pier, ramp and float on said property <br /> Specific findings: #1, #2, #3, #4, #5, and#6. <br /> Mr. Regan seconds the motion. All agree. I <br /> i <br /> _L.Clark Hill, Trustee: Requests an Appeal of the Building Commissioner's stop work <br /> order, to allow for construction of an accessory structure on property located in an R-3 <br /> i <br /> zoning district at 50 Popponesset Island Road (Map 106 Parcel 24) Mashpee, MA <br /> Attorney Kevin Kirrane submitted a letter stating he will be out of town on August 28, <br /> 2002 and requests a postponement for petitioner L. Clark Hill to the next available <br /> hearing which will be September 25, 2002. Present is an opposing abutter, James <br /> Sandler, who expresses his opposition. However, Mr. Regan informs Mr. Sandler that <br /> the petitioner must present their petition before any opposition can be heard. Mr. Sandler <br /> feels this is a spite action and feels the August 21, 2002 letter from Mr. Kirrane was not <br /> enough notice. Mr. Regan informs Mr. Sandler that if he cannot attend the next public <br /> hearing he can write a letter to the Board of Appeals, which will be submitted for the <br /> record. Mr. Sandler requests a copy of Mr. Kirrane's letter and expresses his <br /> i <br /> I <br />
