Board of Appeals Minutes w <br /> September 25, 2002 <br /> 5 <br /> #` Rockland Trust Company: Requests a Special Permit under Section 174-25.F.6 of the <br /> x=3 Zoning By-laws to allow for construction of a commercial building with a drive-through <br /> window on property located in a C-1 zoning district at 5 Shellback Way (Map 81 <br /> Parcels 86, 87, 88, 89) Mashpee, MA. Owner of record: Jean Canning, Trustee. <br /> Sitting: Edward M. Govoni, James E. Regan, III and Robert G. Nelson <br /> Attorney Kevin Kirrane along with Mr. Don Lonergan from DRL Associates, Inc., <br /> who has designed the building, opens for the petitioner and proposes a bank with a <br /> drive-thru window. This site was broken up into four commercial lots but has been <br /> redivided into 2 parcels of land. Access to the site is proposed to be on a 24 foot wide <br /> access easement. Mr. Kirrane explains there is plenty of frontage on Route 28 and <br /> Shellback Way however, the Town Planner has required that this access easement tie <br /> into a proposed road that is situated on an adjacent Fields Point property. This would <br /> enable traffic to enter from Jobs Fishing Road and get to the Deer Crossing Complex <br /> without having to access Route 28. The lot size is conforming, drainage is being <br /> maintained, all setbacks off of Route 28 have been met and the area is in a C-2 zoning <br /> `Y which permits a drive-thru use. The building has been approved with Design Review <br /> Committee and there are no comments from abutters. The Board requests a <br /> landscaping bond for $60,000 and approved landscaping plans from Design Review that <br /> Mr. Kirrane will send over. <br /> z Mr. Regan moves to grant a Special Permit to allow for construction of a commercial <br /> property conditioned upon: <br /> ll <br /> - signed landscaping plans from Mr. Kirrane <br /> - $60,000 landscaping bond <br /> .k - plans from Cape & Islands Engineering, revised July 8, 2002 and August 12, 2002. <br /> Criteria is #1, 2, 3 and 4, 2" section is 1, 2, and 3. (Landscaping wording) <br /> Mr. Govoni seconds the motion. All agree. So moved. <br /> Jen Zylinski: Requests a Special Permit from Section 174-20 to allow for demolition of <br /> one of three pre-existing non-conforming dwellings on property located in an R-3 zoning <br /> district at 70 Riverside Road (Map 119 Parcel 67) Mashpee, MA.
