i <br /> Board of Appeals Minutes <br /> September 25, 2002 <br /> 6 <br /> David Sanicki, of Cape & Islands Engineering opened for the petitioner. Mr. Sanicki <br /> informed the Board that his client received a building permit in error before coming to <br /> kz the Board of Appeals to get a variance and special permit for the above property. The <br /> dwelling is already existing and maintains the same footprint. Mr. Govoni asks which <br /> plans reflect the actual house. Mr. Sanicki told the Board that when his client laid it on <br /> the ground the footprint was pushed forward by about one foot. The old deck/porch <br /> area is now square footage in the house. Mr. Nelson inquires about the lot coverage. <br /> Conservation presented a negative determination. <br /> Mr. Nelson moves to grant a Special Permit to allow the demolition and rebuild of a <br /> dwelling on 70 Riverside Road. Mr. Govoni seconds the motion. All agree. So <br /> moved. <br /> Criteria referenced is dated plan, #2, 3, 5, 6, 7, 8, 9 and 11. <br /> Jen Zylinski: Requests a Variance from Section 174-31 of the Zoning By-laws to vary <br /> the side setback, front setback and lot coverage requirements to allow for construction <br /> of a new dwelling, which would replace one of three pre-existing, non-conforming <br /> x dwellings located in an R-3 zoning district at 70 Riverside Road (Map 119 Parcel 67) <br /> Mashpee MA <br /> Sitting: Edward M. Govoni, James E. Regan, III and Robert G.
