4. The Board finds that, in the interest of integrating the affordable units within the <br /> project, only one of the dwelling units located on Lots 1 and 2 may be designated <br /> as affordable. The Applicant agrees with this finding. <br /> 5. The Board finds that the proximity to Meetinghouse Road could have an adverse <br /> impact to the lots that front thereon. The Board and the Applicant agree that a <br /> vegetated buffer may mitigate this concern. �I <br /> I <br /> II <br /> 6. The Town of Mashpee has not met the statutory minimum set forth in <br /> G.L. c. 40B, §20 or 760 CMR 31.04, nor is there evidence that affordable housing <br /> is located on sites comprising one and one-half percent or more of the total land <br /> area zoned for residential, commercial or industrial use. There is also no evidence j <br /> that development of affordable units consistent with the Application, as amended <br /> would result in the commencement of construction of such housing on sites <br /> comprising more than three tenths of one percent of such land area. <br /> 7. The Board finds that the conditions imposed in the following section are <br /> necessary in order to make properly address local concerns as previously stated <br /> herein. Based upon its analysis of the pro-forma, the Board finds that such <br /> conditions will not render the project uneconomic. To the extent that such <br /> conditions do render the project uneconomic, the Board finds that the local <br /> concerns in imposing the same outweighs the potential benefits of the affordable <br /> units that have been proposed. <br /> 8. The Board finds that the waivers that have been granted will adversely impact <br /> local concerns, but that the local concerns that have been affected thereby do not <br /> outweigh the Town's need for affordable housing. <br /> IV. DECISION AND CONDITIONS I' <br /> Upon Motion of James E. Regan, III, seconded by Zella Elizenberry, the Board <br /> hereby grants the Applicant a so-called "Comprehensive Permit" for the Meetinghouse <br /> Hill, as shown on the Plans, subject to the following conditions: <br /> a <br /> 1. The Applicant shall provide a vegetative buffer along Meetinghouse Road, j �I <br /> provided, however,that such buffer shall not have the effect of adversely <br /> impacting sight distances along roadways. The maintenance of such buffer shall <br /> be a restriction that runs with the land for 1, 2, 3 and 12. Appropriate restrictions, <br /> I <br /> in a form approved by Town Counsel shall be placed on the deeds for each such <br /> lot. The Applicant shall submit a final landscape plan to the Board for approval. <br /> _ 2. The housing types shall be limited to the designs submitted by the Applicant, <br /> including the "ranch" design. Although the Applicant may offer any of the <br /> designs to proposed purchasers of the market-rate units, the Applicant shall ensure <br /> that there is a mix of the chosen styles spread throughout the development. <br /> Attached garages may be added to the housing designs. i <br /> 3 <br />
