Mr. Slavinsky stated that ' 4� <br /> the Conservation Commission has demanded that the proposed construction/work limit " ,4 <br /> shall be 80 to 100 feet from the edge of the vernal pool on the property and indigenous <br /> grasses must be planted. The applicants are requesting a Variance of five feet from the <br /> sideline and front setback requirements. r .f <br /> Mr. Regan asked the Board members for any comments. Mr. Borgeson confirmed that <br /> the applicants and the engineer had complied with the Board's requirement to receive <br /> Conservation Commission approval prior to ZBA approval. <br /> No comments were received from abutters. '4 <br /> Mr. Borgeson moved to grant a Variance of five feet from the side setback requirements <br /> and a Variance of 5 feet from the front setback requirements, subject to plan revised <br /> 3/17/00 and criteria 1, 3, 4 and findings 1, 2, 4. Ms. Elizenberry seconded. Borgeson. <br /> Mr. Paul Moore represented his application and stated that he has been operating a car l <br /> sale business under the name of B &M Auto Brokers across the street from Deer <br /> Crossing. He stated that he has outgrown his current location and proposes to move his a <br /> business across the street to the Deer Crossing parking lot and would occupy an office <br /> space above the market place. Mr. Moore's current license allows him to display only <br /> one vehicle and his proposal is to display four vehicles at a time. He stated that he has <br /> the full consent of Dave Carboneau. f <br /> The Board reviewed the photos of the proposed new location. Mr.Nelson questioned <br /> from where the 50-foot setback is measured. Mr. Hauck stated that the setback is <br /> measured from the property line. Mr.Nelson checked the plan and stated that the <br /> proposal would encroach on the 50-foot setback from the street. <br /> f <br /> Mr. Regan questioned Mr. Moore if he had input from the Selectmen concerning the J <br /> proposal. Mr. Regan referred to another applicant, Mr. Colombo,to whom the Board <br /> granted a similar Special Permit. The Board of Selectmen refused togive Mr. Colombo a <br /> fti <br /> license. Mr. Regan expressed concern that the Board of Selectman would also refuse to <br /> license Mr. Moore's proposal. Mr. Moore said that he had a brief discussion with one of <br /> the Selectmen who stated that Mr. Colombo asked for something that the Zoning Board <br /> of Appeals hadn't approved. <br /> Marjorie Katsoulis, an abutter, claimed that some of the Deer Crossing condominium ,, 4 <br /> residents were not notified of the Public Hearings.
