Mashpee Zoning Minutes—October 11, 2000 9 <br /> Board of Appeals 41r, <br /> Mr. Croopnick also stated that he is opposed to the project because of the basement �i..,.•. <br /> elevation and the "unnecessary height of the finished first floor". He requested that the <br /> Board require the Petitioner to continue,withdraw or resubmit plans with revised <br /> grading, architectural elevations and building heights and landscape plans. <br /> VIII:, <br /> Mr. Grotzke stated that the proposal meets Little Neck Bay's 30-foot setback <br /> requirement. He said that"8 inches above 13"would be the top of foundation and is the <br /> natural grade. Mr. Grotzke said that, out of consideration for the abutter, any additional <br /> grading by the Petitioner would require approval from the Conservation Commission <br /> under an amended order. <br /> Mr. Govoni mentioned, for the record,that on July 12, 2000,the Board granted Mr. <br /> Croopnick the following: I�aPliwuls�I <br /> n1:m��11 <br /> 1. a Special Permit under Section 174-17 of the Zoning By-laws for permission <br /> :,��iw9lnro-t <br /> to make alterations to a pre-existing,non-conforming structure to allow for <br /> construction of an attached garage on property located in an R-3 zoning it <br /> district at 8 Topping Lift. <br /> 2. a Variance from Section 174-47.B.9 of the Zoning By-laws of 10.2 feet from <br /> the rear setback requirements and a Variance 3.7 feet from the right side <br /> setback requirements to the deck to allow for construction of an attached <br /> garage to a pre-existing,non-conforming structure. +IiH II <br /> No other comments were received from abutters. <br /> i <br /> Mr.Nelson moved to grant a Variance of 50 feet to the top of the coastal bank, subject to <br /> criteria 1, 2, 3, 4 and findings 1, 2, 4 and lot coverage at 17.2% is well below the allowed <br /> 30%. The Variance is conditioned upon the Petitioner requesting from the ZBA approval <br /> to make any changes in grading after having received Conservation Commission <br /> approval for it. Mr. Regan seconded. All agreed. <br /> Mr.Nelson moved to grant the Special Permit, subject to findings 1, 4, 6, 7 and <br /> conditioned upon the Petitioner requesting from the ZBA approval to make any changes <br /> in grading after having received Conservation Commission approval for it. <br /> CONTINUED HEARINGS <br /> Robert T. &Nancy B.
