Mashpee Zoning Minutes—February 29, 2001 3 <br /> Board of Appeals <br /> Chilton Development Inc. - Requests a Special Permit under Section 174-25.I.9 of the <br /> Zoning By-laws for permission to modify and maintain an existing pier, ramp and float <br /> on Popponesset Creek on property located in an R-3 zoning district at 128 Waterway <br /> (Map 105 Block 232) Mashpee, MA. <br /> Sitting: James E. Regan III, Richard T. Guerrera and Frederick R. Borgeson. <br /> I <br /> Mr. Michael Grotzke from The Phoenix Group represented the Petition and stated that the <br /> ZBA approved a dock on the subject property in 1993 or 1994. A waterways license was <br /> issued in 1993. Plans call for modification of the existing structure by extending the <br /> dock. The total length will be under the allowed 70-foot length limit. <br /> i <br /> Mr. Grotzke stated that the Conservation Commission, Harbormaster and Shellfish <br /> Constable have approved the proposal. <br /> No comments were received from abutters. <br /> Mr. Borgeson moved to grant the Special Permit, subject to findings 1, 2, 3, 4, 5, 6 and <br /> with reference to the 1993/1994 Special Permit. Mr. Guerrera seconded. Continued from January 10, 2001 Public <br /> Hearings to allow for Conservation Commission approval. <br /> Sitting: James E. Regan III, Richard T. Guerrera and Frederick R. Borgeson. <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petition and stated that plans <br /> call for demolition of the existing structure and construction of a new home on the <br /> subject property. The Conservation Commission has approved the proposal. <br /> The Board discovered that the Petitioner needs a Variance from the lot coverage <br /> requirements. Mr. Grotzke said that the lot pre-dates zoning and he thought that the lot <br /> did not have to meet current lot coverage requirements. Mr. Wheeler stated that the <br /> Petitioner does need a Variance from the ZBA to exceed the lot coverage. The Board <br /> agreed that doing so would be a protection for the homeowner. <br /> l I <br /> No comments were received from abutters. <br /> Mr. Borgeson moved to grant the Special Permit to allow for demolition, subject to <br /> findings 1, 4, 5, 6.
