Mashpee Zoning Minutes—March 28, 2001 11 <br /> Board of Appeals <br /> The proposed golf course expansion would replace the development of 68 permitted lots <br /> in one area and the potential development of 9 or 10 additional homes in another 10-acre <br /> area on the northerly side. <br /> Mr. Besse said that sacrifices have been made so that thero osal would be a"par 35" <br /> P P p <br /> would not be of"champion length". The proposal would encroach 25 feet into the <br /> 50-foot buffer zone for about 800 square feet along Quinaquisset Avenue and along <br /> another 800 square-foot stretch on Sampsons Mill Road. However,the rest of the buffer <br /> would consist of 100 feet from the street. A land swap is planned for the May Town <br /> meeting. <br /> I. <br /> I! <br /> Mr.Besse stated that the Petitioner seeks an informal inquiry of the Board's opinion of <br /> the proposal prior to submission to the Cape Cod Commission. He said that if the Board <br /> was opposed to granting the Variance relief,the Petitioner would be forced to redesign f <br /> I <br /> the proposal and that the golf course would not be of a championship level. The <br /> alternative would be to develop 77 more homes in the area. <br /> ii i r <br /> Mr. Brem questioned if the golf course would be visible from the street. Mr. Besse said <br /> that landscaping and buffers would be installed so that the golfers would not be visible <br /> from the street. <br /> Mr. Guerrera questioned if plans call for construction of a clubhouse. Mr. Besse <br /> indicated that the facilities at present are adequate and that a 20x20-foot restroom with <br /> rain shelter would be provided. <br /> The Board expressed initial approval of the project. <br /> !i <br /> Falmouth Donuts—Definition of proposed use. <br /> A Petition was,filed on November 3, 1999 by Brickyard Marketplace Nominee Trust <br /> for a Special Permit under Sections 174-25.E.2 and 174-251.6 of the Zoning By-laws <br /> to allow for use for retail businesses with the addition of a bank or doughnut shop on <br /> properties located in C-2 and R-5 zoning districts at 93 Old Brickyard Road(Map 72 <br /> Block 22) and 439 Nathan Ellis Highway(Map 72 Block 23)Mashpee, MA. (Owner <br /> of record: Stephen Berish, Trustee, Brickyard Marketplace Nominee Trust.) <br /> At the Public Hearings on December 8, 1999, the Board voted unanimously to grant the <br /> Special Permit. One of the conditions of the Special Permit is that the tenant using the <br /> space shall appear before the Zoning Board of Appeals with a defmition of the proposed <br /> use of the space. <br /> Attorney Robert F. Mills stated that Falmouth Donuts plans to operate a coffee/donut <br /> shop out Unit#1. The drive-through window has been eliminated from the proposal. <br /> I ' <br /> i � <br />
