Mashpee Zoning Minutes—April 25, 2001 3 <br /> Board of Appeals <br /> Mr. Brem calculated that the proposed building would be about 75 feet from the abutter's <br /> house. <br /> Mr. Borgeson asked if the Petitioner has gone before Design Review. Attorney <br /> Oppenheim said that the ZBA is the first Board that has heard these Petitions. Ms. <br /> Elizenberry stated that the Petitioner would also need Conservation Commission <br /> approval. Mr. Borgeson remarked that the Petitioner is coming to the ZBA a little <br /> prematurely. Mr. Brem agreed and said that the Petitions were continued to allow Mr. <br /> Casey an opportunity to start the process with Tech Review and Design Review. Mr. <br /> Borgeson said that the Board does not generally hear a Petition until it has completed <br /> Conservation, Tech Review and Design Review processes and received input/demands. <br /> Then, the ZBA would hear the Petition. Mr. Regan stated that he was a little surprised <br /> that the Board was hearing the Petition tonight. Messrs. Carter and Souza from Carter <br /> and Associates were the Petitioner's lawyer at the initial public hearing on February 28, <br /> 2001. <br /> Attorney Oppenheim asked the Board for permission to fmish the presentation and <br /> indicated that his client was looking for a little feedback from the Board on the Variance <br /> issues and for direction and comment on how to proceed. Mr. Borgeson said that there <br /> may be significant changes between now and when the other Boards have finished with <br /> their review of the proposal. <br /> Mr. Regan said that the ZBA is the final Board and its decision is recordable. He said II <br /> that the situation is not unique and that the Petitioner is not asking for anything <br /> extraordinary. Mr. Regan reminded the Petitioner about the abutter who expressed <br /> concern at February 28, 2001 Public Hearings. Mr. Brem stated that abutters are not <br /> notified of continued hearings by mail or by advertisement. <br /> Attorney Oppenheim apologized and said that the Petitioner does not want to put the <br /> Board in a difficult situation. He thanked the Board for its indulgence and suggestions <br /> and comments. Mr. Regan said that he understood and that the Board wants to be <br /> thorough in order to protect all interested parties. Mr. Regan said that the Board would <br /> not want to see the Petitioner go through the inconvenience of an abutter appealing the <br /> Board's decision. <br /> The Board asked the Petitioner to submit the following information: <br /> • a list of Variance relief being sought. <br /> • when the property was designated commercially zoned. <br /> • detailed list of proposed commercial vehicles—how many, size, etc. <br /> • landscaping and shielding of subject property. <br /> • using colors on the plan to make distinctions between landscaping,parking <br /> lot, etc. <br /> • show corner of Cormier's Route 151 building on the plan j <br /> • show abutter's (Belekewicz)property on the plan. <br /> • move the proposed driveway from Sassacus Road to Algonquin Avenue. <br /> • proposed lighting—location, wattage, height, etc. <br /> I ' <br />
