Mashpee Zoning Minutes—April 25, 2001 4 <br /> Board of Appeals <br /> • proposed signage. <br /> • wood fence/green fence combination <br /> • proposed second building. <br /> Attorney Oppenheim concluded his presentation by spelling out more details of the <br /> proposed buildings, landscaping and parking areas. He informed the Board that one to <br /> two years after purchasing the site,the Petitioner plans to construct the second building <br /> on the subject property. Attorney Oppenheim said that the sloping contour of the lot is a <br /> distinct advantage to the Petitioner and to the abutter since it would mean less visibility <br /> and potential noise from the proposal. <br /> Hours of operation would be from 7 A.M. to 5 P.M. Employees would load up with <br /> equipment in the morning, be on the job sites for the day and would return to the subject <br /> property at the end of the day. <br /> The Board strongly encouraged the Petitioner to work with and be open to concerns from <br /> the abutter, Mr. Belekewicz. <br /> Mr. Regan moved to continue the Petitions until July 25, 2001. Mr. Guerrera seconded. f <br /> I <br /> All agreed. <br /> DUNKIN DONUTS <br /> The Building Commissioner has suggested that the Board release the Landscape and <br /> Performance Security posted by Dunkin Donuts. <br /> Mr. Regan said that the sign has not been posted, that the trucks are still parking in the <br /> "no parking" area across the street on Route 130 and that the street is a mess. The Board <br /> voted unanimously to Deny release of the performance security at this time. <br /> 23 Jeep Place <br /> I <br /> Mr. Brem said that he visited the site and that the Petitioner never got a Variance for <br /> construction of the existing deck. Mr. Brem also said that a neighbor told him that the <br /> owner of 23 Jeep Place has parties with as many as 50 people on the very large deck and <br /> that it encroaches on the setback requirements. Mr. Brem said that the neighbor seems to <br /> feel that the Petitioner is getting away with the violation. <br /> Ms.Elizenberry said that at the last meeting the Building Department confirmed that it <br /> has cited the owner of 23 Jeep Place several times for violations of the By-laws. Mr. <br /> Regan said that often violations are not resolved until a property goes to sale and the bank <br /> discovers the discrepancy. <br /> Mr.Nelson said that the Town is hindered in its pursuit of a great deal of the residential <br /> property violations because of the time, effort and money involved. <br /> I'' <br />
