Mashpee Zoning Minutes—May 23, 2001 2 <br /> Board of Appeals <br /> Mr. Christe Kondochriste, a neighbor, reviewed the plans and expressed concern that the <br /> proposal would interfere with his mooring. Mr. Reall said that the proposal would be <br /> about 40 feet from his mooring. <br /> Mr. Brad Caf-yn asked for a copy of the agreement between the Petitioner and Mr. <br /> Siegfried in writing. Attorney Wightman said that he would supply a copy to the Board <br /> and that Mr. Caf-yn could receive a copy from the Board. <br /> Mr. Brem asked about the swing of the boat and its interference with the existing <br /> moorings in the area. <br /> Ms. Carolyn Anderson asked how many boats would be moored at the proposed dock. <br /> Mr. Regan said that it would only be two boats. Attorney Wightman also said that the <br /> agreement also places other restrictions regarding size and type of the boats to be docked <br /> there. Mr. Blythe said that 28-foot boats with"water only exhaust"would be allowed. <br /> Mr. Caf-yn referred to the letter sent by his mother, Ms. Nancy Caf-yn, in opposition to <br /> the proposal. <br /> Mr. Gary Eynation said that he is concerned about the safety of children in the area. Mr. <br /> Regan asked if Mr. Eynation had any suggestions. Mr. Eynation said that he had no ideas <br /> to offer to the Board. <br /> Mr. Regan asked if a gate would be a good idea. Mr. Blythe replied that anyone <br /> accessing the beach has to walk across his land and that he hasn't gated it for 30 years. <br /> Mr. Blythe said that the dock could not be gated because the dock is not raised and goes <br /> right into the beach. He said that a 20-foot high chain link fence would amount to "visual <br /> pollution". <br /> Mr. Eynation said that Mr. Blythe has been very gracious and allowed people permission <br /> to walk on his land in order to get to the beach. <br /> Mr. Caf-yn said that he has "nothing against Fred; Fred's always been a good neighbor". <br /> Mr. Caffyn said that he and his mother,Nancy,have major concerns about the safety of <br /> children playing in the area. He said that the area is referred to as Fiddler's Cove because <br /> the children go and play with the fiddler crabs. Mr. Caffyn said that the area is away <br /> from the major channel and is shallow. He also said that there are a lot of minnows, -- <br /> clams and eel grass in the area. <br /> Mr. Borgeson asked if Mr. Blythe owned the land down to the shoreline. Mr. Blythe <br /> replied that he did own the land and that it is recorded at Barnstable County Registry of <br /> Deeds. <br /> Mr. Regan referred to a letter from Town Counsel that was stamped as a private <br /> document and not for public record. <br />
