Mr. Borgeson <br /> seconded. All agreed. <br /> Joseph P. Murawski—Requests a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the side setback requirements to allow for construction of a porch <br /> on an existing home on property located in an R-5 zoning district at 31 Nobska Road <br /> (Map 29 Block 101)Mashpee, MA. <br /> Sitting: James E. Regan III, Richard T. Guerrera and Zella E. Elizenberry. f <br /> Mr. Murawski represented his Petition and stated that he is looking to add a 14x16-foot <br /> porch on the east side of his existing home. The close proximity of the wetlands and the j <br /> unusual shape of the lot restrict the location of the porch. Mr. Murawski is requesting a <br /> Variance of 9 feet from the side setback requirements. <br /> The Conservation Commission has approved the proposal. <br /> Mr.Nelson asked if the Petitioner would consider reducing the size of the porch. Mr. <br /> Murawski said that he really prefers the proposed size of the porch. He said that there is <br /> substantial space between his proposal and the abutter's foundation. <br /> i <br /> Mr. Regan said that that lot starts at over 100 foot wide and reduces down to about 40 <br /> foot wide in the back of the lot. <br /> No comments were received from abutters. <br /> it <br /> Mr. Guerrera moved to grant a Variance of 9 feet, subject to findings 1, 2 and criteria 1, <br /> 2, 3, 4, the odd shape of the lot(versus the rectangular shape of the abutting lots) and <br /> decreases in size froml20 feet to 40 feet in width. Ms. Elizenberry seconded. All <br /> agreed. <br /> Chilton Development Company, Inc. —Requests a Variance from Section 174-31of <br /> the Zoning By-laws for permission to vary the rear setback requirements to allow for <br /> construction of a pool and cabana on property located in an R-3 zoning district at 36 <br /> Topping Lift(Map 125 Block 216)Mashpee, MA. ! <br /> Sitting: James E. Regan III, Robert G.Nelson and Zella E. Elizenberry. <br /> Mr. Michael Grotzke of the Phoenix Group represented the Petition and said that the <br /> subject parcel has a new owner. Mr. Grotzke requested Withdrawal Without Prejudice of <br /> the above-referenced Petition. <br /> Ms. Elizenberry moved to accept the request. Mr.Nelson seconded.
