r - <br /> Mashpee Zoning Minutes—May 23, 2001 4 <br /> Board of Appeals <br /> CONTINUED HEARINGS <br /> i <br /> Uldis Ozolins—Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the side setback requirements to allow for partial replacement of an <br /> existing deck with construction of a dining room on property located in an R-3 zoning <br /> district at 23 Jeep Place (Map 118 Block 111) Mashpee, MA. This Petition has been <br /> continued from the April 11, 2001 Public Hearings to allow for the following: <br /> • the Petitioner must submit letters from abutters in approval of the proposal. <br /> • the plan must show location of the septic system. { <br /> • the plan must show exact lot coverage with the proposal. <br /> The Board received a request from Mr. Ozolins requesting a Withdrawal Without <br /> Prejudice of the above-referenced Petition, V-01-39. <br /> Messrs.Nelson and Borgeson suggested that the request should be Denied Without <br /> Prejudice and that the Denial must be accompanied with a stipulation that the Petitioner <br /> must resolve all violations of the Zoning By-laws of his existing house before he appears <br /> before the Zoning Board of Appeals with any requests in the future. The Building <br /> Commissioner has cited the Petitioner several times for violations of the Zoning By-laws. 1 <br /> Mr. Regan suggested that the Board should Deny the Request for a Variance and not the <br /> Request for Withdrawal of the Petition. <br /> Mr. Borgeson moved to Deny Without Prejudice the Petition for a Variance. The Board <br /> reserves the right and has the authority to Deny any future requests for a Special Permit I <br /> or Variance relief on property located at 23 Jeep Place until the existing home at 23 Jeep <br /> Place is in compliance with Zoning and all violations have been resolved. Mr. Brem <br /> seconded. All agreed. <br /> Executive Auto, Inc.—Requests a Special Permit under Sections 174-25.F.2 and <br /> 174-251.3 of the Zoning By-laws to allow for the sale of automobiles and repair of <br /> automobiles on properties located in a C-2 zoning district at 6 Cape Drive and 18 <br /> Falmouth Road(Map 55 Blocks 23 and 24) Mashpee, MA.
