I, <br /> Mashpee Zoning Minutes—October 24, 2001 3 <br /> Board of Appeals <br /> Mr. Regan moved to continue the Petition until December 12, 2001 to allow for <br /> Conservation Commission approval. Mr. Nelson seconded. All agreed. <br /> Ii <br /> Harold R. & Mary H. Williams—Request a Special Permit under Section 174-25.A.8 <br /> of the Zoning By-laws to allow for addition of an in-law apartment to an existing home <br /> on property located in an R-5 zoning district at 141 James Circle (Map 71 Parcel 183) <br /> Mashpee, MA. <br /> Sitting: James E. Regan III, Robert G. Nelson and Marshall A. Brem. Mr. Govoni <br /> stepped down and left the room. <br /> ,i <br /> i <br /> Building Commissioner Russell W. Wheeler said that the Petitioner is currently in <br /> violation of the Zoning By-laws. Mrs. Williams stated that when she bought the home, j <br /> the basement had already been roughed in by the previous owners. She said that she is <br /> requesting ZBA approval for a Special Permit in order to legalize the in-law apartment. <br /> Ms. Karen Lynch, an abutter, expressed approval of the proposal. j <br /> ii <br /> The Board reviewed the plans and photos of the subject property and home. Ms. I' <br /> Elizenberry commented that the home has a walkout basement. Mr. Brem asked if there I <br /> would be any changes to the outside of the home. Mrs. Williams said that she doesn't <br /> plan to make any further changes to the home. j <br /> Mr. Nelson moved to grant the Special Permit, subject to obtaining a building permit and <br /> findings 1, 2, 4, 5, 6. Mr. Brem seconded. All agreed. <br /> I <br /> Calico Real Estate Ltd. Partnership—Requests a Variance - <br /> from Sections 174 31 and <br /> q I <br /> 174-3 <br /> 3 of the Zoning By-laws for permission to vary the lot coverage requirements, rear <br /> and side setback requirements and setback requirements to water and wetlands to allow <br /> for construction of a new home on property located in an R-3 zoning district at 81 Nick <br /> Trail (Map 117 Parcel 99) Mashpee, MA. �I <br /> Sitting: Robert G. Nelson, Richard T. Guerrera and Zella E. Elizenberry. Mr. Regan <br /> stepped down and left the room. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and stated <br /> that the Variance ranted b the ZBA on Januar 24 2001 will expire on Januar 24 <br /> g Y Y p Y u i I <br /> 2002. The Petitioner is requesting the same Variance as filed in Variance, V-00-219. <br /> No comments were received from abutters. <br /> I <br /> Mr. Nelson moved to grant the Variance, subject to same findings as V-00-219. Ms. <br /> Elizenberry seconded.
